Office Depot settlement givers $23M to whistleblower's estate



Office Depot has signed off on its $68.5 million settlement of a lawsuit alleging government customer overcharging.



Whistleblower David Sherwin's estate is slated to receive $23 million of the $68.5 million settlement of a 2009 lawsuit alleging Office Depot overcharged government customers in California.

Both Office Depot and a representative of Sherwin, who died from cancer last year, have now signed the $68.5 million settlement, lawyers for Sherwin said Wednesday. The settlement was filed in Los Angeles Superior Court late Tuesday.

The lawsuit alleged the company overcharged California government customers for notepads, calendars, binders, furniture and other office supplies.

Sherwin died a month after testifying in the lawsuit, his attorneys Phillips & Cohen, said in a news release.

In a separate release, California law firm Sanford Heisler Kimpel broke down the settlement amounts, which include the whistleblower's estate share and $11.66 million to the City of Los Angeles.
Office Depot previously reported its settlement in an SEC filing.
