MEMA chief objects to elimination of emergency buffer at Pilgrim










Decommissioning process still poses substantial risk to public, new director argues.
PLYMOUTH — The state’s top emergency planning official is objecting to a federal exemption allowing owners of Pilgrim Nuclear Power Station to shrink the current 10-mile emergency planning zone around the reactor down to the plant’s property line.
Samantha Phillips, the new director of the Massachusetts Emergency Management Agency, says the “all hazards plan” the state uses for other emergencies would not provide an adequate response for a nuclear accident.
The emergency planning for the zone around the nuclear plant should remain in place until all 3,000 radioactive spent fuel assemblies, currently sitting in a pool on the site, are transferred to heavy steel and cement dry casks, she said.
“The Commonwealth’s overriding interest at Pilgrim Nuclear Power Station is to maintain public safety,” Phillips says in her letter to Scott Wall, manager of the Division of Operating Reactor Licensing, a branch of the Office of Nuclear Reactor Regulation. “While the type and probability of public safety risks at a nuclear power station evolve and reflect whether a plant is active or inactive, a nuclear power station undergoing decommissioning and deconstruction nonetheless presents substantial and complex risks to public safety, especially when spent fuel remains in the spent fuel pool.”
The Plymouth reactor ceased operation May 31. Longtime owner, Entergy Corp., then sold the plant in August to Holtec International, which will handle decommissioning.
Based on a vote earlier this month, the Nuclear Regulatory Commission will allow the elimination of the emergency planning zone, which encompasses sections of Plymouth, Kingston, Carver and Duxbury, come April.
With that elimination comes the loss of about $2 million in annual funding for those towns to be put toward safety training, staffing, equipment and expenses.
Meanwhile, staff at the Pilgrim Nuclear Power Station continues to be reduced. According to Patrick O’Brien, a spokesman for Holtec, staffing is currently at 263 workers and at the end of March or early April the number will drop to 180-185 workers.
“The Commonwealth is deeply concerned that such a reduction in on-site personnel will result in reliance on state and local off-site personnel to address hazardous and potentially catastrophic events at PNPS, such as spent fuel uncovering, fires affecting radioactive materials, and construction accidents,” Phillips wrote.
But O’Brien argued staffing remains robust.
“Pilgrim Station continues to maintain four strong, talented emergency planning teams,” O’Brien said in an email. He added that the exemption from the emergency planning zone requirement was granted “based on science and the low potential for an emergency to expand past the site boundary after the fuel has cooled in the pool for an appropriate amount of time.”
Holtec has said the fuel should all be transferred into dry casks by the end of 2022.
Prior to the Nuclear Regulatory Commission’s vote to grant the exemption to the emergency planning zone, state and federal legislators voiced their opposition.
Federal emergency management officials had expressed concern with the commission’s assumption that state and local responders could provide necessary assistance at the plant during a nuclear emergency, and at the same time evacuate citizens from the 10-mile area around the plant.
Using the “all hazards plan” places “an inappropriate and undue burden on local communities nearby PNPS,” Phillips said. “State and Local agencies will be required to maintain significant and hazardous responsibilities to ensure public safety and disaster response at Pilgrim Nuclear Power Station. Such essential obligations include developing and implementing a wide-scale evacuation and sheltering program.”
Mary Lampert, president of the Pilgrim Watch citizens group, said the damage caused by a nuclear accident, even with the plant shutdown, would be devastating.
“Until all spent fuel has been moved from the spent fuel pool into dry casks, the risk of a spent fuel pool fire remains, resulting from acts of malice, a fuel handling accident during transfer, equipment failure or human error.” Lampert said. “The NRC estimated that the offsite consequences of a major pool fire could include contaminating as much as 38,610 square miles of land, forcing the evacuation of millions, and trillions of dollars in damages.”
Jeff Baran was the sole commission member to vote against granting the exemption. Although Pilgrim is shut down, Baran said, “EPZs should be in place to provide defense-in-depth because the probability of an accident involving a significant release of radioactive material, although small, is not zero.”
David Lochbaum, former director of the Nuclear Safety Program for the Union of Concerned Scientists, agreed with Baran’s concern. He said maintaining an emergency planning zone is “akin to passengers on cruise ships having a reserved spot in a lifeboat along with a life preserver.”
“Eliminating emergency planning with irradiated fuel in the spent fuel pool is gambling with American lives as table stakes,” Lochbaum said.
Attorney General Maura Healey sued the commission last month for approving the transfer of Pilgrim’s license from Entergy Corp. to Holtec International without first listening to what state officials and the public had to say about it. Healey contends Holtec is inexperienced in decommissioning and will likely run out of money before the job is done.

Attorney general’s office says problems with Nuclear Regulatory Commission’s e-filing system responsible for tardy submission.
BOSTON — State Attorney General Maura Healey missed the deadline for filing a request to federal regulators for a temporary hold on Pilgrim Nuclear Power Station’s approved license transfer.
The attorney general’s office had until midnight Sept. 3 to submit the request, 10 days after staff of the Nuclear Regulatory Commission approved Pilgrim’s license transfer from Entergy Corp. to Holtec International.
The attorney general missed the deadline by 22 minutes because of the size of the submission, the request and 1,800 pages of accompanying data.
According to excerpts from the filing provided by the attorney general’s office, the application was filed late due to a problem with the commission’s e-filing system. The office originally attempted to send the stay application, as well as a supporting appendix, at 11:40 p.m. Sept. 3, and “made repeated unsuccessful attempts to resubmit” the materials, on multiple web browsers, between then and 12:22 a.m. Sept. 4, when the materials were successfully sent.

In a separate filing, the AG’s office said staff with the commission’s electronic submissions help desk have since confirmed that issues with the e-filing system prevented the stay application and appendix from being submitted on time.
“The late filing was based on an inadvertent and unanticipated event beyond undersigned counsel’s control and thus excusable,” the filing reads.
While Healey has asked for a retroactive deadline extension to allow for the filing, attorneys for Holtec International and Energy Corp., the present and former Pilgrim license holders, are urging the commission not to do so.
In a five-page submission to the commission, the power companies say the attorney general had ample time to file her request for a stay and instead decided to do it at the last minute.
Entergy and Holtec say the commission had already granted a deadline extension from five days to 10 to accommodate an earlier request from the attorney general.
“The Commonwealth’s sole justification for missing the extended deadline is problems encountered with NRC’s e-filing system in the final minutes before the deadline,” the power companies say. “It should come as no surprise to experienced litigants that online filing can encounter technical difficulties, takes time, and occasionally requires multiple attempts to upload very large files.”
The companies also noted that NRC staff had announced on Aug. 13 its intent to approve the transfer.
In her request for a stay, Healey said NRC staff violated the agency’s own regulations by failing to act on her petition to intervene within the necessary 45 days. The petition has been pending since February.

Pilgrim advisory panel laments lack of power

PLYMOUTH — The Nuclear Regulatory Commission came to Plymouth Wednesday looking for suggestions from the public on the formation of citizens advisory boards to provide input into the decommissioning of nuclear plants in their regions.
The timing of the meeting was ironic, said several of the 150 or so people who turned out.
On Aug. 22, the Nuclear Regulatory Commission approved the transfer of Pilgrim Nuclear Power Station’s license from Entergy Corp. to Holtec International. The move was made with no input from the public, attendees said.
Former state Sen. Dan Wolf, who lives in Harwich and serves on the Nuclear Decommissioning Citizens Advisory Panel for Pilgrim, pointed out that irony.
“You’re here tonight saying you want to hear from the public,” Wolf said. “They’ve been knocking at your door, and they’ve been disregarded and disrespected.”
Petitions to intervene in the license review process and to hold public hearings prior to a decision had been submitted several months ago by Attorney General Maura Healey and Pilgrim Watch, a local citizens group. But the requests were never acted on by the NRC.
“It is hard to take the NRC’s search for best practices seriously when our community members too often saw the worst of government bureaucracy and corporate indifference throughout the process, ” said U.S. Sen. Edward Markey, D-Mass., in a letter read by his representative at the meeting. “When we needed reassurance and responses, we got delayed and denied.”
Representatives from the offices of Sen. Elizabeth Warren, D-MA, and Rep. Bill Keating, D-Mass., leveled similar criticisms of the NRC’s review process.
Federal regulations, policies and practices are “rigged in favor of the nuclear industry,” advisory panel Chairman Sean Mullin said.
Representatives from Entergy who serve on the panel told fellow members three months ago that Pilgrim’s license transfer to Holtec was going to be completed Aug. 21, Mullin said. They were just one day off, he noted. It was approved Aug. 22.
“Lesson learned: the fix was in,” Mullin said. “Holtec refused to negotiate with the state because they knew they didn’t need to, they could just run out the clock. They knew the license transfer was going to be approved.”
Mullin said citizens advisory boards are not effective because they lack clout. Such boards need the authority to make decisions.
Diane Turco, president of the Cape Downwinders, called to abolish the NRC and to replace it “with an independent intergovernmental agency.”





Turco, like Mullin, said citizens advisory boards should be made up of state and local stakeholders “that have real power to influence and enact policies and practices for the protection of the communities.”

State Rep. Mathew Muratore, R-Plymouth, said during the meeting that he had initially been surprised that the NRC scheduled a session in Plymouth just two weeks after approving Pilgrim’s controversial license transfer.
Then NRC representatives explained the session helped fulfill requirements of a new federal law.
“Congress made you be here,” Muratore said of what he believed to be the agency’s motivation. “You didn’t want to be here.”
Under the Nuclear Energy Innovation and Modernization Act, which became law on Jan. 14, 2019, the NRC is required to prepare a report for Congress on the best practices for advisory boards in communities around decommissioning nuclear power plants.
The meeting in Plymouth was the sixth of 11 such sessions planned in host communities nationwide.
Representatives from Holtec International and Pilgrim attended the meeting but did not speak.

Startup promotes permanent nuclear waste storage

A small startup company in Berkeley, California, with connections to scientists, university professors, industry experts and Silicon Valley entrepreneurs is marketing a method to permanently store nuclear waste, tapping advanced drilling technology used for years by the gas and oil industries.
Storage of the highly radioactive waste would be permanent — unlike the options currently available around the world — and the method is being pitched as far less expensive than development of a deep geologic repository such as Yucca Mountain in Nevada.
The proposal from Deep Isolation calls for drilling a 14-inch-wide vertical access channel up to a mile or more down, depending on geologic conditions, then gradually making the drill hole run horizontally along the line of the rock formation.
The horizontal bed, which could be as long as 2 miles, would serve as the nuclear waste storage area, deep in the subsurface where the rock has been stable and out of contact with the surface for millions of years and would remain out of contact for millions more, unaffected by surface impacts such as sea level rise.

Hundreds of corrosion-resistant canisters, each holding a spent fuel assembly, could be stored in a line inside a single drill hole, and since the technology already exists, the company could be placing fuel in the ground within two to three years, according to Sophie McCallum, Deep Isolation’s chief of staff.
And more than one drill hole can be made on a site.
“We are in active discussions with potential customers in the U.S. and internationally to move forward disposal programs of stalled nuclear waste inventories,” McCallum said in an email.
Deep Isolation recently tested its system, installing a drill hole in Cameron, Texas, where it successfully placed a 5-foot-long canister — the kind used to store military waste such as cesium and strontium — in the horizontal storage area, deep underground. It then retrieved the canister, which Deep Isolation experts say could be done for up to about 50 years.
The company plans to begin with storage of defense waste in the U.S. and commercial waste in other countries, since the federal Waste Policy Act must be amended to allow for permanent storage of the nation’s commercial waste in places other than Yucca Mountain.
Currently about 80,000 metric tons of spent nuclear fuel produced by commercial reactors and another 14,000 metric tons from the nation’s weapons program is being temporarily stored at 80 sites in 35 states, in spent fuel pools or hulking dry casks.
In New England, spent nuclear fuel is being stored on-site at the Maine Yankee, Seabrook, Vermont Yankee, Yankee Rowe, Pilgrim and Millstone nuclear plants.
Although the Department of Energy was required under the Waste Policy Act to remove spent fuel from sites nationwide for storage in a permanent repository by 1998, its plan for a Yucca Mountain repository in Nevada has languished for several years.
Commercial reactor owners have sued the department for failing to provide promised permanent storage, and damages to date have cost the agency more than $6 billion.
In 2016, the department was investigating a method of storage that called for deep, vertical boreholes into crystalline basement rock, but the program was broken off in 2017 with Yucca Mountain once again taking over as the sole focus for permanent, high-level nuclear waste storage.
Holtec International and Waste Control Services have submitted applications to operate interim storage facilities in New Mexico and West Texas that are under review by the Nuclear Regulatory Commission. Spent fuel would be stored at those locations until a national repository is ready.
“We will provide an option for people not satisfied with existing options,” said Deep Isolation’s co-founder and CEO Elizabeth Muller. She pointed out the interim sites were not “deep geologic storage.”
“They’re looking at being safe for decades,” Muller said. “They’re looking at temporary storage. We’re looking at disposal.”
A representative from Nuclear Energy Institute, a lobbying and support organization for the nuclear industry, attended Deep Isolation’s demonstration.
“I was curious,” Rod McCullum said. “Deep Isolation is innovative; I wish them the best. If they can find customers and succeed, that’s a good thing.”
McCullum said his organization does not discourage private initiatives such as Deep Isolation, but it staunchly supports the government’s development of Yucca Mountain as a deep geological repository.
Every nation in the world is developing a deep geologic repository. “We stand by the scientific consensus,” he said.
“Right now, we have too much at stake to walk away from Yucca Mountain,” McCullum said. “We believe the science is sound, and we think walking away from the investment would be foolish — $10 billion in ratepayer money has already been spent.”
Several nuclear watchdog groups have advocated for keeping waste at sites where it has been generated rather than transporting it across the country to other locations. Deep Isolation’s storage method can be done at or near the generation sites, depending on the geology.
“We’ve looked at a dozen sites and, based on our desk research, they all look suitable,” Muller said.
Community consent is part of the process. If community members support storage near their nuclear plant sites, Deep Isolation geologists will do on-site drilling to determine conditions.
Deep Isolation was established about three years ago and has operated to date without government or institutional funding but hopes that will change.
“Our financial model is to develop a public-private partnership, where Deep Isolation assists the government with stakeholder engagement, site characterization, drilling, waste handling, etc.,” said Sophie McCallum. “The government would be the license holder, have title for the waste, and benefit from the reduction of cost.”
The government estimates it will cost $100 billion to dispose of existing nuclear waste at Yucca. “We project that the cost of Deep Isolation disposal is about one-third of a mined repository,” McCallum said.
David Lochbaum, former director of the Nuclear Safety Program for the Union of Concerned Scientists, has taken a seat on Deep Isolation’s advisory board.
“There are technical, legal and political challenges facing Deep Isolation, to be sure,” Lochbaum said via email. “I think their proposal could very well meet all these challenges.
“The spent fuel storage status quo is only worsening with time,” he said. “We need to find a solution before we run out of time to do so without harm.”

PLYMOUTH — Massive concrete and steel casks, described by their manufacturer as providing “an impregnable barrier,” will protect the public from radiation emitted by the 4,000 spent fuel assemblies left behind at Pilgrim Nuclear Power Station when the reactor permanently shuts down in May.
But how long will that protection last?
Developed by Holtec International, the company planning to buy Pilgrim and handle its decommissioning, the HI-STORM 100 casks are certified by the Nuclear Regulatory Commission for 20 years. Yet the spent fuel contained inside will remain radioactive for thousands of years.
Those facts were troubling to members of the Nuclear Decommissioning Citizens Advisory Panel on Wednesday, as Holtec representatives highlighted the “robust” program they plan for long-term handling of Pilgrim’s spent nuclear fuel.
The fuel assemblies will be placed into stainless steel canisters equipped with baskets of neutron-absorbing material developed by Holtec and capable of withstanding the heat generated by high burnup fuel.
The steel canister is then housed in an outer shell of carbon steel, with 27 inches of poured concrete separating the two.
The casks, each weighing 350,000 pounds, could take a direct hit from an F-16 fighter plane filled with fuel, a Boeing 767 traveling at 350 mph and withstand a raging brush fire with no release of radiation, Holtec representative Joy Russell said.
The company envisions the design life of the casks to be about 100 years, according to Stefan Anton, Holtec’s vice president of engineering and licensing. Once the 20-year federal certification is up, Holtec will return to the NRC for extensions, Anton said.
Advisory panel member John Flores, a Barnstable town councilor, questioned how the 100-year figure was arrived at, since the first such cask was loaded with spent fuel only in 2000.
“The 100-year life expectancy is theoretical,” Flores said. “In reality, 18 years is all you have as evidence.”
Even 100 years falls considerably short of what is needed, noted panel member Daniel Wolf, a former Cape and Islands state senator, who said the fuel would be radioactive for much longer. “We’re putting something that lasts for thousands of years into a container that lasts for 100,” he said.
Panel member Kevin O’Reilly, of Plymouth, asked Anton how his company came to the conclusion a cask could last for 100 years.
“As long as we take care of it, it is going to last a long time,” Anton said.
Inner canisters would be randomly tested for leakage, he said. If a leak was detected, the canister would be placed into a slightly larger one. “We’ve never had to do that,” he said.   


Duxbury resident Mary Lampert, president of Pilgrim Watch, pointed out only one canister is chosen for testing. “That doesn’t mean you’ll get the important one — the one with the crack,” she said.
Wolf asked Russell how long the casks were under warranty, and was told the information was confidential since it was a contractual issue.
The answer frustrated panel Chairman Sean Mullin.
“We are the people that are going to have to live with it, so if it’s a confidential contract, that’s going to be a real problem,” he said. “A lot of the answers you have given are soft, so we may come back and ask you in writing.”
