Route 44 Toyota Illegal Business Practices Continue

Rather than end up like this:



We left our brand new Prius that Route 44 Toyota refused to repair or replace on their property because it had NO BRAKES.

Recently, as previously posted, it was discovered that Route 44 Toyota had illegally requested credit reports three times via Credco.


The new Consumer Financial Protection Bureau [CFPB] that the GOP so wants to gut provides protection not otherwise available.

A complaint was filed against Route 44 Toyota because of their illegal access of CREDIT REPORTING INFORMATION, a violation of federal law [FCRA - Fair Credit Reporting Act].

Describe what happened so we can understand the issue...

On April 23, 2012, I presented payment in full for the cost of a new vehicle purchased at Route 44 Toyota, Raynham, MA.

I did NOT apply for credit, yet Route 44 Toyota requested my credit information.

On October 11, 2012, Route 44 Toyota, Raynham, MA requested not only my credit information, but that of a disinterested third party. We did NOT travel to the dealership and we did NOT apply for credit on that date.

Desired resolution
What do you think would be a fair resolution to your issue?

1. Investigated - this seems to be a common violation of FCRA by Route 44 Toyota and mandates investigation. Its affiliated dealerships may employ the same abusive tactic as well.

2. Cessation - Route 44 Toyota needs to immediately cease this illegal business practice.

3. Removed - since these unauthorized Credit Inquiries reduce FICO removed in a manner that removes harm from FICO scores, as they have ours. 4. We have suffered financial damage as a consequence, as surely have others. We need to be reimbursed for those damages, as well as the statutory fine levied.

5. Future credit information access by Route 44 Toyota and its affiliates needs to be closely monitored to avoid abuse.

The vehicle I purchased from Route 44 Toyota is 'defective' - it had NO BRAKES and a complaint has been filed in Plymouth District Court to address that matter. I am currently considering all of my legal options regarding credit abuse by Route 44 Toyota. At this time, I do not waive any legal options I may have.


CREDCO'S reply:

Our investigation into this matter determined that [complainant's] credit report was ordered by our client, Route 44, on or about April 23, 2012 and October 11, 2012, respectively.

In order to obtain these credit reports on Route 44 represented to us each time that it had a permissible purpose to do so.

After receipt of this complaint, Credco contacted Route 44 and confirmed the certification of permissible purpose.


In other words, CREDCO didn't request written documentation, just shrugs their shoulders at their participation in the illegal business practices of Route 44 Toyota.
