David Gerrold: IMPEACHMENT INSIGHT



So ... we know that he's an illiterate, ignorant, incompetent, narcissist who doesn't admit failure — and yet he has declared bankruptcy more times than some people change their underwear. (I wish this particular comparison was only a joke. It isn't. )
We also know that he's a bully and a coward.
So while on the one hand, he has a track record of running from any possible admission of failure — he never acknowledges all those bankruptcies, except as wins (because it was the other guys who lost their shirts) — on the other hand, he's terrified of failure. It's not part of his identity.
He knows that his residency in our White House may very well be terminated soon. He doesn't want to be impeached, but he doesn't want to be arrested either. The bad news there is whether or not he is impeached, whether or not he is convicted, whether or not he is reelected, arrest is inevitable.
So really, the options aren't good.
1) Fight impeachment. That's not an option. He will be impeached in the house. That's inevitable. The Democrats now have enough votes to pass a bill of impeachment.
2) Try to keep the Senate from convicting him. He has two chances of that. Fat and slim. The Republican Senators are in the process of sending signals that they are more concerned with saving their own asses than his. At least 30 Republican Senators have indicated their willingness to convict if the vote is secret. That position will change as the rest of the evidence of criminal corruption is revealed. So he still ends up convicted and arrested.
3) Resign and avoid the public humiliation. And then be immediately charged, arrested, and held accountable. If he is charged under the RICO laws, he forfeits all property.
4) Run away. Be "president" in exile. I rather like this option. It would make for a great political thriller.
5) Become medically incapacitated, physically unfit for trial. This is his best option. It lets him get away with it. Although he still loses control of his "empire."
6) It is unlikely that he will escape conviction. But if he does, then he runs for reelection. It is unlikely that he will survive the growing tsunami of nationwide revulsion, but with enough electoral chicanery, he could hang onto the Blight House. In that case, all bets are off — because this nation will not survive four more years of this reign of error.
7) If he is convicted, he will not go down alone. Others will go down with him. That is likely to happen whether he is convicted or not. So the Republican party has a serious problem for the 2020 election. It would be a Goldwater scenario. In 1964, the Republican party knew they couldn't win the White House. The electorate was solidly Democratic, but more than that, there was a smoldering resentment of the right wing hate campaign that had been aimed at JFK and a vague suspicion that right wingers had set up the assassination. Even Goldwater knew he couldn't win — so the goal wasn't winning as much as it was establishing legitimacy of the right-wing ideology for the future. Whoever inherits the nomination, he will be a placeholder while the party tries to rebuild itself on the state levels.
Given that a Democratic president will likely serve two terms, all the way to Jan, 2029, then the Republicans will have most of a decade to rebuild themselves. Because they have had such success with a half century of lying, cheating, and stealing, ever since Nixon, do not expect the party to change. Based on the evidence of history, however, you can expect a massive rebranding while the same kochroaches continue to dictate robber-baron policies. Short of a massive internal collapse, I cannot imagine the Republican party coming back as a legitimate political party — they're owned by the religious fanatics, the racists, and the robber-barons in an unholy triumvirate of mutual advantage. The robber-barons loot the public treasury, the evangelicals get to control the religious conversation, and the racists get to pretend legitimacy. That kind of alliance will not die easily.
I could be wrong on any of these things — I was wrong when I said he would never get to the White House. I did not factor in the meddling of Russia and a multi-million dollar social media campaign by paid trolls and volunteer assholes, as well as the pretense to legitimacy of that bullshit that came from the Fox Noise pulpit.
The one thing that is true is that we are in a chaotic situation. We have been in a long-running Constitutional crisis and we do not yet know how it will resolve itself.
But it will resolve, one way or another. Tyrannies do not last. They crumble from within. They collapse. They get overthrown. Tyrants die. And sometimes there are revolutions. Sometimes peaceful. Sometimes not.
But tyrannies do end.
Myself, I believe the best option is 100 million voters go to the polls and vote blue.

Please indulge me a personal memory:
News of the passing of Joe Wilson brought obituary tributes and flashbacks to a different time, particularly his important role in the national drama around the lead up to and execution of the second Iraq War. But for me, the headlines of his death transported me a decade earlier, although the stage was still Iraq.
The United States was on the brink of its first war with Saddam Hussein and a CBS reporting team and I were some of the few westerners in Baghdad. Joe Wilson, at the time already a seasoned diplomat, had been left in charge of a skeletal team at the U.S. Embassy. The mood in the Iraqi capital was tense and there was word that Hussein was going to round up westerners to act as human shields in advance of an anticipated U.S. aerial assault.
Wilson was as tough and as savvy as they got and was handling the final drawdown of American foreign service members with steel-eyed precision. But he also saw the bigger picture
He told me "You and the rest of your co-workers should leave as well Dan, but I know you won't." So he made a remarkable arrangement. He left the phone lines open at the Embassy and allowed us to stay, even after he had pulled out, thinking, correctly, that it would be extremely provocative for the Iraqi forces to storm what was in essence U.S. soil. It was an act I will never forget, demonstrating a deep respect for his role and that of the press.
I soon had to leave as well to get back to New York to anchor, and the wheel of historical fortune continued to turn. Much has transpired since those days, but it is a moment and a man I will never forget.

Moreover, talk of congressional strategy and procedure is boring. That’s true even for law professors like me. It’s one thing to believe that impeachment is necessary; it’s quite another to think about how the House will carry it out.
But here, process is profoundly important. As Joshua Matz and I explain in our book, To End a Presidency: “Procedure is where romantic ideas about legislators as the voice of the people collide with institutional reality. Good process is crucial to making thoughtful, accurate, and legitimate decisions. It’s through these rules that Congress evaluates the evidence and structures its deliberations … Impeachments must therefore be fair and appear fair.”
First and foremost, that means undertaking a thorough investigation. The House cannot make a reasoned judgment about whether to impeach – and what to include in articles of impeachment – without a clear understanding of what exactly Trump (and those in his orbit) did wrong. And there is clearly much more to this story than is yet known publicly.
Don’t get me wrong: we already know a lot from the rough transcript of Trump’s call with Ukraine’s president, the whistleblower complaint, Trump’s public statements, and credible news reports. That information alone supports a powerful case for impeachment. At minimum, it shifts the burden to Trump to disprove the obvious inference that he abused power, violated his oath, betrayed the nation, and acted corruptly.

How Do Mass. Business Taxes Compare to Other States?

Did you know that Massachusetts has relatively low business tax levels compared with other states? Or that two elements of our state's corporate tax code result in a significant loss of its revenue? That's what you can learn and more in our new series of reports that examine how specific corporate taxes impact the Commonwealth.

The first fact sheet, How Do Business Taxes in MA Compare to Other States?, draws on an analysis of business taxes as a percent of the private economy which was conducted by a national business association, the Council on State Taxation (COST).
The analysis shows that:
  • At 3.9 percent, Massachusetts' total effective business tax rate is significantly below the national average of 4.5 percent.
  • Only eight other states have lower total effective business tax levels than the Commonwealth.
  • Massachusetts' business tax levels rank in the bottom fifth of all states by this measure. 
Our other fact sheets analyze various elements of the corporate tax code. "Together, these reports help us understand that Massachusetts business taxes as a share our economy are relatively low compared to other states, and two business tax provisions that we highlight here appear outdated, ineffective, and unnecessarily costly to the Commonwealth," said Marie-Frances Rivera, MassBudget's President.
 
One special business tax break- The Single Sales Factor- changes the share of multi-state corporations' profits that are taxable in Massachusetts. This tax break, while showing no discernible benefit, reduces revenue that could be used to invest in our Commonwealth's economy.
As discussed in MassBudget's fact sheet, the Mass. Department of Revenue estimates this tax break will cost the state $400 million in Fiscal Year 2020. Champions of this tax break originally promised that it would be worth the expense by increasing manufacturing employment. But in the years since enactment, Massachusetts has lost about 40 percent of its manufacturing jobs. Only four states lost a larger percentage of their manufacturing jobs than Massachusetts between 2000 and 2014.
Our other new report in this series focuses on the corporate minimum tax in Massachusetts. Corporate Minimum Taxes in Massachusetts Could Be Better Targeted as in Other States, explains how states have long established minimum corporate excise taxes as a backstop to ensure all corporations pay some income tax, regardless of how much they report in profits. The report shows that Massachusetts' corporate minimum tax has not been changed in 30 years.
Since 1989:
  • $456 is the minimum amount corporations are required to pay in Massachusetts, regardless of their size.
  • 70% percent of all businesses that filed corporate excise taxes in Massachusetts paid this in 2015 - including many, very large corporations.
  • According to the Department of Revenue, in 2004, over 2,000 corporations with gross receipts over $50 million paid only the $456 minimum tax.
  • More recent studies show that even many Fortune 500 companies pay no state income tax other than this minimum.
Several states have targeted their minimum corporate taxes so that businesses with larger volumes of sales pay larger minimum amounts. In New York, for example, the minimum corporate tax tops out at $200,000 for companies with over $1 billion in New York receipts.

Scientists blast Maine lobstermen’s whale safety stance

Eighteen scientists who work in North Atlantic right whale research and rescue have said the Maine lobster industry is “significantly underestimating” the harm their equipment causes.
The scientists have called on the state of Maine to support the National Marine Fisheries Service in developing new rules to protect the whales from lobster gear injuries.
“Reducing entanglement in East Coast waters of the United States is a critical part of a comprehensive strategy for right whale survival and recovery,” Scott Kraus, chief scientist for marine mammals at New England Aquarium’s Anderson Center for Ocean Life, and Mark Baumgartner, associate scientist at Woods Hole Oceanographic Institution and chairman of the North Atlantic Right Whale Consortium, said in a letter Tuesday to Sen. Susan Collins, R-Maine.
In addition to Kraus and Baumgartner, other scientists at WHOI and the Anderson Center for Ocean Life in Boston signed the letter, as well as leaders from the Center for Coastal Studies in Provincetown and the International Fund for Animal Welfare, which has an operations center in Yarmouth Port.
The letter to Collins comes after the Maine Lobstermen’s Association announced Aug. 30 that the state’s five lobster industry representatives had withdrawn support for a key regional pact agreed to in April. The pact focuses on reducing vertical lines in the water and modifying trap and pot gear to better protect right whales from becoming ensnared in fishing rope. Each lobstering area agreed to area-specific goals.
The pact by Maine, New Hampshire, Massachusetts, Rhode Island and offshore commercial lobstermen — as well as other stakeholders such as scientists, conservationists and state regulators — came after a steady decline since 2010 in the right whale population, which now stands at about 400. The loss of 29 whales in the past three years in U.S. and Canadian waters is considered particularly critical, according to scientists and conservationists.
The documented death on Sept. 16 of a 40-year-old male right whale, known as Snake Eyes, reported 5 miles south off Long Island, was the first carcass reported this year in U.S. waters. Eight right whale carcasses have been documented this year in the Gulf of St. Lawrence in Canada. Snake Eyes was last seen alive Aug. 6 in the Gulf of St. Lawrence, with fishing rope wrapped through his mouth. His tail appeared to drag toward the bottom, meaning he may have been anchored to the ocean floor.
The Maine association said on Aug. 30 that substantive errors in the National Marine Fisheries Service data presented in April and a last-minute focus on the Northeast lobster industry led to errors in assigning relative risks to all sources that have the potential to harm right whales. Ship strikes, gillnets and the Canadian snow crab fishery pose greater risks, according to the Maine association.
But in Tuesday’s letter, the scientists disagreed with the Maine association. Statements made by Maine officials “do not reflect the facts in hand and minimize or ignore the changes needed to prevent the North Atlantic right whale from going extinct,” the scientists said.
Right whales are common in Maine waters, the scientists said, and are likely significantly underestimated by fishermen and managers — because of the high density of zooplankton present and the lack of systematic whale population surveys in recent years. The high lobster trap counts, the current lax gear-marking scheme and problems with both recovering and identifying fishing gear of any kind combine to significantly underestimate numbers of entanglement events in Maine waters, the scientists said in the letter.
Maine lobstermen fish about 3 million traps, representing an estimated 87 percent of the U.S. Atlantic lobster fishery, but only a few entanglements have been tracked to Maine because it is extremely rare to identify the origin of gear to any fishery, according to the scientists. Additionally, 70 percent of Maine waters are exempt from regulations requiring fishing gear to be marked with country and state of original.
“It is not currently possible to determine if right whale entanglements originated in Maine,” the scientists said.
In summary, the scientists said, the number of right whales in Maine waters, the number of entanglements occurring there, and the severity of all entanglements and their effects on the right whale population “are all significantly underestimated.”
Sen. Collins’ office did not respond to a request for comment, nor did Maine Lobstermen’s Association Executive Director Patrice McCarron.
The National Marine Fisheries Service said that it will continue — despite the withdrawal of the Maine lobster industry — to prepare a draft environmental impact statement on the proposed gear changes in the Northeast, based on the April pact.
″(National Marine Fisheries Service)’s own data show that the lobster fishery is the least significant cause of right whale serious injury or mortality, while ship strikes, gillnets and the Canadian snow crab fishery pose much greater risks,” McCarron said in the Aug. 30 announcement.
The Maine association said its own analysis revealed the Canadian snow crab fishery accounts for 31% of right whale serious injury and mortality, gillnet and netting gear represent 13%, unknown trap/pot gear represents 4% and U.S. trap/pot gear represents 4%.
U.S. and Canadian vessel strikes account for the remaining 48%.

Former Gov. Michael Dukakis thinks that when it comes to managing transportation in the state, Gov. Charlie Baker has been doing “not so hot.” To Dukakis, who was famous for being spotted on the MBTA, the governor has no vision when it comes to the potential of public transportation throughout Massachusetts.
“You’ve got to have a plan,” Dukakis said during an interview with Boston Public Radio on Friday. “What’s the vision? What’re you trying to do here?”
Dukakis has long advocated for the North-South Rail Link, a proposal to add a rail line that connects North and South station. Advocates of the system say it will open up public land for sale or development, make commute times shorter, and most importantly reduce the congestion that has been plaguing Boston.
Baker has been firm in his opposition to the project. In September, the Baker administration released an assessment of the potential costs of the North-South Rail Link that said it could cost anywhere from $12 billion to $21.5 billion. Advocates, however, criticized the report for not taking into account potential costs savings. In a 2015 op-ed, Dukakis and former Gov. Bill Weld claimed that the connection could save $2 billion that will be needed to create layover facilities in Allston and South Boston to grapple with the increasing congestion both stations are experiencing.
Dukakis also criticized Baker’s narrow focus on fixing the MBTA’s core system and called for an investment in the creation of a regional rail network that can connect Boston to other gateway cities and other existing transit lines in other states.
“This is not complicated stuff,” Dukakis said. “You know, the rail network exists out there. It’s just a question of fixing it up and putting management and good equipment on it.”
Dukakis also said that Baker has not proposed a “serious plan for dealing with congestion yet.” For Dukakis, the key to solving Boston’s transportation crisis is expanding the MBTA’s rail network to other cities. Once that is done, Dukakis believes, it will reduce the high demand for housing in Boston and improve economic productivity throughout the state.

The lies that work

It used to be that centrist Democrats would simply ignore

Now that they can't do that anymore, they're spending
donor money - most of it from Democrats - to figure out
how to kill support in the party for single payer.

According to a Bloomberg piece published yesterday, 
a new poll by a firm linked to Joe Biden is testing 
messages designed to undercut support among 
Democrats for Medicare for All.

"The survey, commissioned by the centrist Democratic
think tank Third Way, found that primary voters start off f
avoring the government-run health care system by a margin 
of 70% to 21%, but can be persuaded to oppose it.
The study showed that Democrats are most swayed by the
arguments that the program would impose a heavy cost 
on taxpayers and threaten Medicare for senior citizens."

Of course, Medicare for All would actually mean lower costs for middle and lower income families, and Medicare would be expanded to finally provide comprehensive coverage to seniors (and everyone else!)

The only effective way they've found to compromise the case for single payer is to lie about the benefits of a national plan and scare us into fighting over the crumbs of a private health insurance system that stratifies patients by design.
 We don't have financial resources to match our opponents' - but we have people. And Healthcare-NOW's work supporting Medicare for All activists all across the country is essential to inoculating the public against these attacks and keeping the fire burning for the only real solution to our healthcare crisis.
