States Sue Trump Over Blocking of California Emissions Rules

On September 6, the Wall Street Journal reported that the US Department of Justice launched an antitrust probe of Ford Motor Co, Volkswagen AG, BMW AG, and Honda Motor Co - automobile companies that struck a voluntary agreement with California to reduce vehicle emissions.
The rules, which date from the era of former US President Barack Obama, called for a fleet-wide fuel efficiency average of 46.7 miles per gallon by 2025, with average annual increases of about five percent, compared with 37 miles per gallon by 2026 under the Trump administration's preferred option to freeze requirements.
US Secretary of Transportation Elaine Chao said Thursday that the administration will finalise revisions in the coming weeks. "No state has the authority to opt out of the nation's rules," she said, "and no state has the right to impose its policies on everybody else in our whole country."

ACLU Report Alleges Medical Neglect, Maltreatment at Aurora ICE Facility Run by GEO Group

Samimi was taking methadone and did not receive appropriate medical care for his withdrawal, which a federal investigation later found fell short of ICE standards.
But Samimi was not the only detainee who suffered medical maltreatment at the Aurora facility, according to a new report released Wednesday by the American Civil Liberties Union of Colorado.
The 42-page report details alleged medical abuses and neglect at the Aurora facility, which is operated by The GEO Group under an ICE contract. Detainees are “confined without access to sufficient medical care, adequate nutrition, legal resources or, in many cases, basic human decency,” the ACLU report says.
Despite those shortcomings, the report notes, The GEO Group reported a net income of $33.4 million in the fourth quarter of 2018 and is valued at $2.3 billion.

to protect the ranch from an approaching lightning-sparked wildfire. 
That arson reportedly endangered volunteer firefighters camped 
nearby. The government would seek $1 million in damages.

Q: Where is this?

A: The building seized by the militants is at the Malheur Wildlife Refuge — a remote, marshy oasis in Oregon's high desert famed for its spectacular migratory bird populations. The standoff is in the remote southeast of the state — far closer to the Nevada line (124 miles) and Boise, Idaho (217 miles), than to Portland (305 miles). The closest city is Burns, Oregon, population 2,800, 30 miles to the north. 
Q: What sparked the militia takeover?

A: The answer here is complicated. In short, the militants are outraged about a mandatory minimum sentence received for arson by a local rancher and his son.

Q: So some Oregon ranchers got busted for arson. Where's the tyranny?

A: The ranchers' case became a cause celebre in the patriot/militia movement because the pair were sentenced for their arson crimes under a provision of a law called the Antiterrorism and Effective Death Penalty Act of 1996. And they were oddly sentenced twice.
The federal law in question doesn't just deal with terrorism. It created a five-year mandatory-minimum sentence for arson on federal land: "Whoever maliciously damages or destroys... by means of fire...any...real property...owned or possessed by...the United States...shall be imprisoned for not less than 5 years…" 
The first federal judge to handle the case concluded that the mandatory sentence was too stiff and gave the pair far lighter sentences, which they served. But the U.S. attorney in the case called foul; the federal government took the rare step of appealing the sentence. In October 2015, the Ninth Circuit imposed the mandatory minimum, ruling that: "given the seriousness of arson, a five-year sentence is not grossly disproportionate to the offense." The ranchers are due back in federal prison Monday to serve out their five years each.
But this odd re-sentencing, under a statute that makes it sound like the cattlemen were being prosecuted for terrorism, inflamed the paranoid passions of the anti-government patriot and militia movements, and brought the militants to Burns for a rally on Saturday.
Q: The Bundys are involved in this, aren't they?

A: Yup. Tensions between Western ranchers and the federal government have been running at a fever pitch since an armed standoff between supporters of Cliven Bundy and the federal Bureau of Land Management. Recall that Bundy does not recognize the claim of the federal government to the land that his cattle roam in Nevada. He owes more than $1 million in unpaid grazing fees and fines. The feds briefly seized his cattle back in 2014, leading to an armed standoff that the feds chose to de-escalate rather than risk provoking another deadly showdown like occurred at Waco or Ruby Ridge in the 1990s.
Q: So Cliven Bundy is in Oregon?

A: No, but at least two of his sons are. Ammon Bundy appears to be leading the takeover. In a videoposted to Facebook, he declares: "We have basically taken over the Malheur Wildlife Refuge. And this will become a base place for patriots from all over the country to come and be housed here and to live here. And we're planning on staying here for several years." Calling his group "the point of the spear," Ammon Bundy called on like-minded militants to "bring your arms." 
Q: What do the militants want?

A: In a phone in interview with The Oregonian, another Bundy son, Ryan, laid out the militants' demands: that the Hammonds be released and that the surrounding federal lands be ceded to local control. "The best possible outcome is that the ranchers that have been kicked out of the area... will come back and reclaim their land, and the wildlife refuge will be shut down forever and the federal government will relinquish such control," Ryan Bundy said. He added, "What we're doing is not rebellious. What we're doing is in accordance with the Constitution, which is the supreme law of the land."
Q: Has the federal government reacted to this latest Bundy provocation?

A: Not yet.

This, that, Oregon WHITE DOMESTIC TERRORISM: Fox News = Fake News = Cult



Armed men including the Bundys have taken over a federal building in Oregon. 
Imagine if a Black Lives Matter protestor or immigration advocate said 
anything like the Bundys have said.
Fox News supports the right to protest, unless, it seems, the protesters 
are students of color shining a spotlight on incidents of racial injustice.

The Money Behind Fox's Promotion Of Cliven Bundy's Battle With The Feds

Right-wing media have been rushing to distance themselves from the Nevada rancher they've spent weeks championing after Cliven Bundy revealed his racist worldview, but two of Bundy's biggest cheerleaders -- Sean Hannity and Fox News -- have vested corporate, financial, and political interests in the promotion of Cliven Bundy's anti-government land ownership agenda.  

Nevada rancher Cliven Bundy became Fox News' favorite folk hero after he refused to comply with court orders directing him to remove his trespassing cattle from public land. Hannity and many other right-wing media rallied around Bundy and his armed supporters as they threatened violence against federal law enforcement officials attempting to impound Bundy's cattle and collect the $1 million he owes in fines and fees after decades of noncompliance with the law.

Bundy has said he doesn't recognize the existence of the federal government nor its authority over the land and has attacked the federal ownership of lands as subverting Nevada's "state sovereignty." 

Hannity has promoted Bundy's anti-government rhetoric, arguing that the federal government owns far too much land and pushing Bundy's claim that not only does the federal government not have land-ownership authority but that they don't need or use the land they claim to own. On the April 23 edition of his show, Hannity attacked the government for owning too much land, agreeing with Fox News legal analyst Andrew Napolitano that they do not have the constitutional authority to own any of the land. Throughout the land battle, Hannity continuously argued that the government is irresponsibly fighting for land they have no intended use for -- such as building hospitals, schools, or roads -- and should focus their efforts elsewhere to rapists, murderers, criminals, and pedophiles.

Bundy and Hannity's promotion of state ownership of federal lands gives airtime to an issue that conservatives have long been campaigning for but have had difficulty getting voters excited about -- an issue in line with the land  interests of the Koch brothers. Slate reported on April 23 that the Fox News corporate, financial, and political interests being served by Hannity's promotion of Bundy lie in the network's connection to the Koch brothers:
Bundy's anti-federal agenda is closely aligned with that of Charles and David Koch, major Republican donors who have been pushing for states to gain control over federal lands - so they can be sold or leased to people like the Koch brothers in deals.
Fox News Network and Sean Hannity have a particular interest in the promotion and realization of such Koch interests because their funding depends on it -- Hannity receives major funding and large ad buys from Koch-affiliated Heritage and Tea Party Patriots.

Hannity's Koch-affiliated funders have a long history of promoting the privatization of public lands and condemning the federal ownership of land. Tea Party groups have supported local efforts to transfer federal lands. Heritage has advocated shrinking the U.S. government's control by selling its physical assets such as "huge swaths of land (especially out west)." Heritage was also a loyal promoter of the Federal Land Freedom Act of 2013, advocating for the transfer of federal land management to state regulators for energy resource development.

Giving airtime to an issue that is obscure but significant to his conservative funders makes perfect sense for Hannity. Politico reported that Heritage began sponsoring Hannity in 2008 and in 2013 Hannity began advertising for the Tea Party Patriots, "lending his name to fundraising drives, hosting its leaders on his radio and Fox News shows, and even using the Fox airwaves to promote the Tea Party Patriots website."

The Koch brothers have been covertly funding right-wing organizations such as Heritage Action and the Tea Party Patriots through the non-profit business league Freedom Partners whose tax code status as a trade association allows the organization to conceal its donors. Freedom Partners is one of the largest donors of conservative groups and its board has deep ties to the Koch brothers with many of its members being longtime employees of Koch Industries and the Charles G. Koch Foundation.

The Koch-funded Freedom Partners made grants of $236 million in 2011; among many conservative groups its recipients include Heritage as well as the Tea Party Patriots. Heritage Action received $500,000 in 2011 from the Koch brothers through Freedom Partners and additional funds from the Charles G. Koch Charitable Foundation. In 2012, the Tea Party Patriots received $200,000 from Freedom Partners. 

The legislative efforts of such groups to transfer control of federal lands to states are "nothing more than corporate-backed messaging tools" initiated by conservative groups like the Koch-affiliates. Such efforts are rooted in the interests of the Kochs and other conservative groups to use the land in whichever way is most profitable to them such as mining, drilling, and other resource extraction.

You have to give Captain Daniel Shays this: When he launched his armed sedition against lawful authority, he at least was invited in. Overnight on Saturday, in an obscure corner of the Oregon wilderness, and contrary to the law, and in defiance of democratic authority, both federal and local, another act of armed sedition was committed. It seems to me that this ought to be a bigger story than, say, the belated prosecution of Bill Cosby, or whatever most recently came out of the mouth of the vulgar talking yam. In a small place in Oregon, the essential compact of the United States of America has come apart.
The Bundy family of Nevada joined with hard-core militiamen Saturday to take over the headquarters of the Malheur National Wildlife Refuge, vowing to occupy the remote federal outpost 30 miles southeast of Burns for years. The occupation came shortly after an estimated 300 marchers—militia and local citizens both—paraded through Burns to protest the prosecution of two Harney County ranchers, Dwight Hammond Jr. and Steven Hammond, who are to report to prison on Monday. Among the occupiers is Ammon Bundy, son of Nevada rancher Cliven Bundy, and two of his brothers. Militia members at the refuge claimed they had as many as 100 supporters with them. The refuge, federal property managed by the U.S. Fish and Wildlife Service, was closed and unoccupied for the holiday weekend.
(This is also something you have to give to Captain Daniel Shays. He put a little more of his ass on the line. His act of armed sedition aimed a little higher than the occupation of the vacant headquarters of a bird sanctuary.)
Before moving on to the larger issues, it's important to note that the local authorities, and the local citizenry, want no part of this noisy claque of armed meatheads.  It is popular among these people who apparently have brains wired like short-wave radios broadcasting from upper Michigan to say that the real constitutional authority in this country resides in its local sheriffs. Well, the local sheriff in this case would like it very much if this particular invasive species would abandon his jurisdiction and go back to freeloading on federal lands in Nevada.
Harney County Sheriff Dave Ward told people to stay away from the building as authorities work to defuse the situation, The Oregonian reported."A collective effort from multiple agencies is currently working on a solution. For the time being please stay away from that area. More information will be provided as it becomes available. Please maintain a peaceful and united front and allow us to work through this situation," Ward said in a statement.
Hell, even the convicted arsonists on whose behalf this action allegedly was undertaken have distanced themselves from these clowns.
The Hammonds said they have not welcomed the Bundy's help. "Neither Ammon Bundy nor anyone within his group/organization speak for the Hammond Family," the Hammonds' lawyer W. Alan Schroeder wrote to Sheriff David Ward.
This is an act of armed sedition against lawful authority. That is all that it is, and that is quite enough. This is not "an expression of anti-government sentiment." Flipping off the governor as he drives by is "an expression of anti-government sentiment." What Alex Jones does every day is "an expression of anti-government sentiment," and god bless them all for it. That's what the Founders had in mind. This is not an "occupation" following "a peaceful protest." That would be all those folks who got bludgeoned and pepper-sprayed out of Zuccotti Park a couple of years back. (And when exactly did ABC News decide it wasn't a news organization anymore?) These are men with guns who have declared themselves outside the law. These are men with guns who have taken something that belongs to all of us. These are traitors and thieves who got away with this dangerous nonsense once, and have been encouraged to get away with it again, and they draw their inspiration not solely from the wilder fringes of our politics, either. Ammon Bundy and his brothers should have been thrown in jail after they gathered themselves in rebellion the first time.
This is another step down the road that leads to the broken shell of the Murrah Building in Oklahoma City. There are respectable people in our respectable politics who have been shamefully silent on the subject, and there are respectable people in our respectable media who seem terrified of calling this what it is. You want an example of the deadening effect of "political correctness" in our politics? Watch what the people running for president have to say about this episode. Look at how it is being framed already—or ignored entirely—by the elite political media. There is a constituency for armed rebellion in this country that is larger than any of our respectable political and social institutions want to admit. It is fueled by reckless, ambitious people who engage in reckless, ambitious rhetoric.
It did not begin in Burns. It did not begin on the Bundy Ranch, either. In its most modern form, and in the form most relevant to recent events,  it began, as so many noxious elements of our politics did, with the Reagan Administration. It began with a man named Ron Arnold, and a Secretary of the Interior named James Watt, and in something called the Wise Use movement with which the Republican party (and the conservative movement that became its fundamental life force) allied itself for its political advantage in the western part of the country.
Much of this popularity can be explained by the lingering economic recession of the early 1980s, which provided a receptive grassroots audience for the Wise Use claim that it is easier to force nature to adapt to current corporate policies than to encourage the growth of more environmentally sound ways of doing business. Wise Use pamphlets argue that extinction is a natural process; some species weren't meant to survive. The movement's signature public relations tactic is to frame complex environmental and economic issues in simple, scapegoating terms that benefit its corporate backers. In the movement's Pacific Northwest birthplace, Wise Users harp on a supposed battle for survival between spotted owls and the families of the men and women who make their livings harvesting and milling the old growth timber that is the owl's habitat. In preparation for President Clinton's forest summit in Portland, Oregon, Wise Use public relations experts ran seminars to teach loggers how to speak in sound bites. Messages such as "jobs versus owls" have been adapted to a variety of environmental issues and have helped spark an anti-green backlash that has defeated river protection efforts and threatens to open millions of acres of wilderness to resource extraction.
That was the respectable—if undeniably destructive—part of the movement. Its philosophy, however, was embraced by the growing militia movement in the same part of the country. Its philosophy ran in poisoned tributaries to all points of the political compass until it gathered itself into a great reservoir of toxic fantasy, and that is where the essential compact of the United States of America was encouraged to break down.
There is no actual tyranny in this country against which to take up arms. There is bureaucratic inertia. There is pigheaded bureaucracy. There even is political chicanery. But there is no actual tyranny in the Endangered Species Act, or in the Bureau of Land Management, or in the Environmental Protection Agency, or in the Affordable Care Act, or in IRS dumbassery, or even in whatever it is that the president plans to say about guns in the next week or so. Anyone who argues that actual tyranny exists is a dangerous charlatan who should be mocked from the public square. Anyone who argues that there is out of political ambition, or for their own personal profit, should be shunned by decent people until they regain whatever moral compass they once had.
It does us no good to ignore what is going on in this obscure little corner of the Pacific Northwest. It does us no good to refuse to hold to account the politics that led to this, and the politicians who sought to profit from it. It does us no good to deny that there is a substantial constituency for armed sedition in this country, and to deny the necessity of delegitimizing that constituency in our politics, and the first step in that process is to face it and to call it what it is.
And, in related news, of course, Tamir Rice is still dead.
