This week’s hero is Justice Anthony Kennedy, whose opinions in three key Supreme Court cases – upholding the Affordable Care Act, ruling that the Fair Housing Act of 1968 bars housing polices having a discriminatory effect regardless of intent, and finding that the Constitution allows gays and lesbians to marry – advanced the cause of social justice in America.
It’s easy to forget this is the same Anthony Kennedy who provided the deciding votes both to gut the Voting Rights Act of 1965, opening the door to voter suppression, and to give corporations a First Amendment right to spend as much on politics as they wish, thereby allowing big money to inundate American politics. Kennedy’s opinions this week, as wise and thoughtful as they are, don’t begin to compensate for the profound damage he and his four Republican brethren on the Court have done to our democracy.
