PTC: None Too Happy! #3

The LEMON LADY'S Attorney ABSOLUTELY refused to re-schedule the Pre-Trial Conference and Case Management scheduled for September 17th, leaving the Three Stooges Attorneys mighty unhappy that they were forced to actually appear in Plymouth Court House rather than merely create a few more billable hours with paperwork.



 
 
There has been a long history of PROCRASTINATION, CONFLICTS, DELAYS, STALLS, and SILLINESS.....
 
 

 
in the process.
 
It's important to remember this is about a BRAND NEW LEMON TOYOTA and the ILLEGAL BUSINESS PRACTICES of ROUTE 44 TOYOTA.
 


About the funniest darn thing was the young Morrison & Mahoney Newbie's  little tantrum that he needed his time to DEPOSE the LEMON LADY!

MORRISON & MAHONEY has spent GOBS of MONEY defending a $1400 rental charge based on a FORGED SIGNATURE!
 
 
 
That's the problem when DILLY, DALLY, DELAY, STALL & BILL 'EM LAW FIRMS have DEEP POCKETED CLIENTS that aren't paying attention and don't care about the CRIMINAL CONDUCT of their offices.

Morrison & Mahoney's reputation has preceeded them as the KINGS of DILLY, DALLY, DELAY, STALL & BILL 'EM long before this matter arose and they are merely confirming that reputation, at Hertz's expense, another DEEP POCKETED CLIENT that has failed to monitor its business practices.



The youthful new hire has dragged attendance to his court dalliances.....his predecessor filed the wrong forms with the wrong court because of lack of adequate supervision.



Attorney Laurence Boyle via his clone, protested that he didn't have to name a Hertz person as requested to be deposed according to rule Blah...Blah...Blah.

My attorney subpoenaed the office manager, Paul Salisbury....Ooops!

The Dilly, Dally, Delay, Stall & Bill 'Em Firm is fighting that!



Do you want to know why the COST OF LITIGATION is so HIGH?

The original charge from HERTZ that I was told would be paid by Route 44 Toyota was

$1400!

Toyota: This Gets Betterer and Betterer! #3

Nothing necessitates a review of the Dilly, Dally, Delay & Stall tactics employed....they ignore pending matters, wait until the last minute and extend timelines for MONTHS.



They appear late to court.....

The Keith Rose Associate was forced to chase the 2 other attorneys across the parking lot because of her tardiness arriving from Albany, NY without even calling the court or another attorney.




Dilly, Dally Dan Viera arrived BREATHLESS...and LATE!





That's the problem with a deep pocketed client [Toyota U.S.A.] picking up the tab for Route 44 Toyota and no one supervising the Folly!

Toyota: This Gets Betterer and Betterer! #2

After months and months of Dilly, Dally, Delay & Stall tactics, it almost seemed as if depositions would be taken next week.

The HERDING OF CATS was evident!



My attorney attempted to be considerate, speed the process, reduce legal fees after many delays by the Dilly, Dally, Delay & Stall law firms have worked their magic for more than a year by consolidating the depositions....




....you know the Ca Ching! Ca Ching! of traveling from Albany NY



since Toyota U.S.A. has determined there is NO OTHER qualified attorney betwixt and between.



Attorney Rose developed a sudden case of COMMITMENT...the reason for which he swore my attorney to secrecy since he didn't want to see it on my blog....doesn't really sound like a court conflict, does it?

Dilly, Dally Dan Viera suddenly discovered his clients had a Toyota Convention in Atlanta....must have been a last minute thing, right?



My attorney proposed deposing the other Route 44 Toyota employee instead.


Ooops! That employee is no longer with Route 44 Toyota.....but the employee roster seems to be evaporating......

Alas! The Plaintiff injured her back because of previous CAR ACCIDENTS!

Her DEPOSITION must be postponed.

Suddenly, Attorney Keith Rose, Toyota U.S.A. attorney wants to travel to Massachusetts in his BMW to depose a former Route 44 Toyota employee????

The Endless Love Story.................

Route 44 Toyota doesn't want to sever the relationship!



After Herding Cats, the Deposition date and deponents [parties to be deposed was set]! Phew!




SATURDAY MORNING, TODAY [7-27], Dilly Dally Dan Viera notified all of the attorneys involved [the cats that have been herded], the Route 44 Toyota Employee set to be deposed left their employment LAST WEEK!

It's rather curious that Route 44 Toyota no longer lists a Service Manager, something another LEMON owner pointed out to me.

While never previously counted, the Salesman who sold the Toyota LEMON to me is no longer employed.

Since Route 44 Toyota is over-bearing, everyone [mostly men] hands a new car owner a business card. Reviewing that stack.....hmmmm.....many missing in action......

Of course, Route 44 Toyota is 'under construction' .....



Since Route 44 Toyota resembles a Disaster Area, it's not exactly welcoming to car buyers.



 
The poll below should surprise no one, yet it's revealing that folks rank car salesmen lower than Congress. The reasons seem clear......
 

Poll: Car salesman is least trustworthy profession

Americans trust the people they buy their vehicles from less than members of Congress and stockbrokers.

Since 1977, Gallup has conducted a poll of the most trustworthy professions, and nearly every year, car salespeople have come in last. This year is no different. Just 8 percent of those polled said they believed auto salespeople to be "very trustworthy."

"Car salespeople have been at the bottom of the list every year except 2011, when they tied members of Congress with a 7 percent honesty rating," a Gallup statement read. "Car salespeople's perceived honesty has never climbed out of the single-digit range in the history of the list."

Is this reputation justified? Have car salespeople earned their negative image?

According to car salesman Mark McDonald, his job is a tough one. McDonald details his work life for Motor Trend's Car Salesman Confidential blog. "My average week is somewhere between 50 and 60 hours — and that’s considered 'part time,'" he writes, noting that he's on his feet throughout his shift and that his income is nothing if not spotty.

"If you don’t sell a car, you don’t get paid. Simple as that. Sell or starve," McDonald continues. "You never know for sure what your next paycheck will be. Will it be enough to pay your rent? Cover your child support? Put food on your table for your wife and kids? Pay their medical bills? Put gas in your car so you can get to work the next day?"

Does this "sell or starve" ethos -- standard for sales jobs regardless of the industry -- breed or attract a scrappy image that customers interpret as untrustworthy? Perhaps. Insurance salespeople and advertising practitioners also came in low in Gallup's poll.

In an increasingly competitive market where cultivating any new edge could benefit sales, dealerships may want to think about training their employees better or hiring for trustworthiness. "There are very clear financial reasons why it’s good to have repeat customers, particularly at franchise dealers," Bailey Wood, a representative for the National Automobile Dealers Association, told Exhaust Notes.

"We want them to come back for service, warranties, when it's time to buy a new car. If they have a bad experience, that doesn't happen," Wood said. "There’s so much competition in the marketplace for each individual sale, so it’s important that you build a relationship."

One, presumably, that's built on trust.

Deep Pocketed Clients, Cash Cows and Insanity

This is an up close experience with the arrogance and stupidity of Big Corporations that wasn't planned.

While no legal expertise is professed, this requires public disclosure.

It's been written elsewhere that when a Big Corporation whines and laments about the HIGH COST of LITIGATION, these Deep Pocketed Clowns caused it themselves.  



There are at least 3 trips by the cute, young associate from Attorney Rose's Law Firm that were unnecessary, IMO. [There may have been more before I figured out the Folly.]

#1. The first was when Attorney Toyota U.S.A. arrived LATE, after the matter was heard and the court adjourned.

Attorney Toyota U.S.A. was forced to jog across the parking lot to retrieve the other 2 attorneys [Dilly, Dally, Dan Viera and Wet-Behind-the-Ears from Morrison & Mahoney.]

Attorney Toyota U.S.A. DID NOT even have the courtesy to offer an explanation or CALL the Court House or one of the other attorneys! [My attorney called her office and the only information available was 'she's on her way.']






It might be a good guess that Toyota U.S.A. Attorney was forced to do so to justify her BILLABLE HOURS - Ca Ching! Ca Ching!

The purpose of Attorney Toyota U.S.A.'s trip was to POSTPONE the PTC [Pre-Trial Conference] until JULY [date come and gone with other nonsense]. That also might have been accomplished by mutual agreement without the travel time, expense. Ca Ching! Ca Ching!

[Of course, the postponement was necessary because Toyota U.S.A. sat on the case for months and months, only delivering the request for discovery and interrogatories the week before court. Good excuse for postponement!]

Alas, Dilly, Dally, Dan Viera's 'BILLABLE HOURS' are picked up by Toyota U.S.A. [see 93B, explained here: Route 44 Toyota: NOT indemnified for their illegal actions].

Wet-Behind-The-Ears Morrison & Mahoney Newbie, representing Hertz, another Deep Pocketed Client with No Sense, willingly returned to court. [For the little he has done, he also has filed errata with the court. Again, maybe due to inadequate supervision.]

[Maybe Attorney Toyota U.S.A. and Dilly, Dally Dan Viera were at that court event as well......no attendance sheet was kept.]

#2. The next time Attorney Toyota U.S.A. appeared in court was to add 3 WORDS that could have been accomplished by telephone. No telephones in Albany, NY? No U.S.P.S. service in Albany, NY?  Ca Ching! Ca Ching!

#3. And most recently, when Dilly, Dally Dan Viera filed a motion to prevent his clients, the owners of Route 44 Toyota from being deposed, Attorney Toyota U.S.A. travelled to Massachusetts. Ca Ching! Ca Ching!

This had nothing to do with Toyota U.S.A. and Attorney Toyota U.S.A. did NOTHING other than announce her name in court. Ca Ching! Ca Ching!

Route 44 Toyota: Where Arrogance and Disregard of ...


Nothing like a CASH COW in your legal practice!

 


Sputter, spew, lament and make excuses as you choose.

Toyota U.S.A. has determined that ONLY an Attorney traveling from Albany, NY [Ca Ching! Ca Ching!] will do!


Toyota U.S.A. sent a GAGGLE of folks for the NHTSA inspection to freeze their Twinkies on a brisk New England Morn, sending them the day before from California, returning a day later, two nights in hotels/motels, airfare, meals.... Ca Ching! Ca Ching!


And because Attorney Toyota U.S.A. intends to conduct ANOTHER INSPECTION after the Plaintiff's deposition....Ca Ching! Ca Ching!



You see how they've increased their own expenses?

Part of the litigation process is the inclusion of SETTLEMENT discussions to unclog the Court's calendar.

With DEEP POCKETED CLIENTS who are fully uninvolved with the Mockery, where's the incentive?


This isn't about what's right, what's legal, repairing a DEFECTIVE TOYOTA VEHICLE that in time will force a RECALL because of BRAKE FAILURES.....

NOPE!

It's about BILLABLE HOURS and clients with DEEP POCKETS who fail to reign in the foolishness.


Forests of trees have been destroyed.......




While it may be mildly amusing to watch......those DEEP POCKETED Clients have spent FAR more than the initial value having absolutely nothing to do with me.

Making a mockery of the legal system.......the endless nightmare






Months ago, the Albany NY Attorney representing the deep-pocketed Toyota U.S.A. client traveled to court, threw a temper tantrum that the interrogatories and discovery MUST be completed by the Plaintiff [ME] before they could schedule an INSPECTION of the LEMON TOYOTA......whining that they hadn't received them yet.




Huh???

The sound heard from Attorney Keith Rose in the LOONNNGGG interim.....





Except the CLOWNS neglected to acknowledge they had only submitted the requests the week before.




[Sorry! If you want to be treated respectfully, don't behave like CLOWNS!]

It would seem that Attorney Keith Rose from Albany NY has a DEEP POCKETED client he neglected and ignored for months and months.....apparently Toyota U.S.A. has determined that no suitable attorneys exists elsewhere.

The interrogatories and discovery were promptly completed by me and Attorney Rose selected a satisfactory date for a deposition in MAY.

Then cancelled at the last minute 'due to a conflict.'

After witnessing the recent circus, the MAY date seems disingenuous.



NEXT CHAPTER: After much jostling, Attorney Rose and the rest of the Cats to Be Herded determined August 6th and 7th worked for EVERYONE!

OOPS!


 

Suddenly, as if my MAGIC, Attorney Rose has a CONFLICT!




And then......Dilly, Dally Dan Viera suddenly remembers that his clients, Route 44 Toyota owners, Tim and Denise Bruno [scheduled to be deposed - last chapter of the LEMON LADY prevailing in court] will be in Atlanta for a Toyota Conference or whatever.

Route 44 Toyota: LOST to a LEMON!

Gee.....do you think an attorney representing a 'blah, blah, blah......$100 million corporation....' might have confirmed the date before committing for his clients? Do you think folks would write things on their calendars .... or at the very least have a secretary capable of writing do so? Didn't someone have to make reservations, book plane flights....?

Not to be outdone, Attorney Keith Rose, Albany NY representing Toyota U.S.A. disclosed his reasons for cancelling, swore my attorney to secrecy because......he didn't want to see it posted on my blog!



Let's not ignore the Young Twerp for Hertz working for Morrison & Mahoney, a firm with a reputation of spending BUCKETS defending nonsense. [The Young Twerp seems nice, rather inexperienced, only admitted to the bar last year. An improvement over his predecessor who filed with the wrong court, used the wrong procedure. Maybe inadequate supervision.] 

Let's not forget that Hertz FORGED my name and the total balance was only $1400.

Morrison & Mahoney are blessed with another DEEP POCKETED client that ignores the facts and ignores common sense.



 When Corporate America laments the HIGH COST OF LITIGATION, THEY caused it, not me!


BOTTOM LINE: Let's not forget that Toyota killed 89 PEOPLE [that we know of] because Toyota refused to address or correct their SUDDEN ACCELERATION problem. [Many of those lawsuits were settled with GAG ORDERS - we will NEVER know!] If you review the complaints posted on the numerous web sites including NHTSA and the Center for Auto Safety, it seems that Toyota is UNRESPONSIVE if you have a problem with your Toyota.

Remember that only a small percentage of people report complaints.
Remember that Toyota U.S.A. and Route 44 Toyota and Hertz  always have the option of settling this matter rather than continuing to de-forest mountains, waste the court's time and continue the LEMON LADY CIRCUS!

2042: Owner Deceased, Vintage 'NEW' 2012 Toyota For Sale LOW, LOW, LOW MILEAGE! NO BRAKES!


PUBLIC NOTICE:


To settle estate, a VINTAGE 'NEW' 2012 Toyota is offered for sale.

Elderly, wrinkled owner passed away after many years and many $$$ trying to simply get her $$$ back.



A group of obstinate Dilly, Dally, Delay & Stall Law Firms delayed and stalled resolution until most were deceased.



The original owner of this 2012 Toyota with NO BRAKES recently passed away and the VINTAGE Toyota remains on the property of what had previously been Route 44 Toyota and is now Fleecerino Slot Barn.
