Ask yourself: Is this a business you want to patronize?

When the LEMON LADY posted that ROUTE 44 TOYOTA ILLEGALLY requested credit reports, the BULLYING began with threats of a SLAPP SUIT [Strategic Lawsuit Against Public Participation]  intended to intimidate and silence.

Yup! We know how that worked out!

In the upper left hand corner of this blog is a 'SEARCH' feature. You can find out anything you never wanted to know and bore yourself silly about SLAPP or FCRA [Fair Credit Reporting Act] by filling in the space and clicking.

ROUTE 44 TOYOTA blah, blah, blah, reputation to protect, blah, blah, blah, $100 MILLION corporation, blah, blah, blah........

Why couldn't they fix the TOYOTA LEMON?

Folks, Bullies only win when you remain SILENT about your experience!

The ROUTE 44 TOYOTA ILLEGAL BUSINESS PRACTICES only continue because people remain silent.

Below are some folks WHO have shared their experiences with ROUTE 44 TOYOTA on facebook:

Donna Horgan McAvoy I would NEVER !!! I left a deposit on a car . Changed my mind thank god. They sold the car and I still didn't get my money back . Kept my deposit on a car they didn't hold for me . Three trips to the rout 44 Toyota dealership and four months later I got my money back .

Chasity Armstrong-Menard I bought my Prius from them. It was a horrible, awful experience. I felt blackmailed and cornered into the purchase. Very happy with the car, two years out, but extremely disappointed in how I, as a customer, was treated.

Joseph Barnicoat I went in to look at a truck, the salesman took a credit card "to run a credit check". When they wouldn't move on the price I said I wasn't interested and could I get my card back. Someone else came back with the salesman saying I already made a deposit. It wasn't until I started "very loudly" dropping F bombs, calling them thieves and crooked, did a manager race over, apologize profusely and get me my things back. The next day I bought a Nissan Frontier.

Butch Domenica I was sold a Hyundai Tiburon In 2002..total scam by rt 44

Marianne Carpender route 44 Hyundai too!!

Elizabeth Schmoopie This is not the first person I've heard having this problem with this dealership.

Brett Joseph Bought a broken pos Celica from them worst mistake of my life

Amy Dutzmann I bought a Tacoma and with in 6 months leafsprings and shocks broke, and the 4-wheel drive didn'twork in low. they told me it could haul a horse trailer that weights 5000 pounds and it was a 4 cylinder. Later I bought a Tundra at a different dealer but brought it to rt 44 for the recall. I never had a problem with this truck until I brought it in for the recall. When I got it back the power starring motor feel off when I was driving down the street. Then every thing was starting to fall apart. I had to sink in $2000 in repairs in 3 months after they touched it. They said it was not their fault.

Another Route 44 Toyota customer!

Good for you! My husband stood out infront of Rt 44 toyota with this sign and they threatened him that they were going to call the cops and they told him they would help out and work something out 3 hours later they basically wanted us to b...uy a new car from them (NO HELP) They couldnt even tell me what was wrong with my car it was almost paid off just over the mileage and they were saying that they had to replace all the wiring would cost 5K just for the parts not even including labor and that might not fix the problem!

TOYOTA: Did you think I would go away?

Running an errand to pick up bird seed, the cashier has never seen my 'advertising'!
[There's another INFORMED CONSUMER!]

Departing the store, young couple behind us, man said 'I like your advertising!'
[Another INFORMED CONSUMER!]

At a doctor's office, nurse says 'ya know, I've seen a car around town.....' [she raved about Copeland Toyota in Brockton!].

At a local building supply store, 2 young fellows [if they're under 50, they look young], smile and announce they've been on facebook.

Handouts have run out again because so many interested people have taken them while the LEMON LADY'S car or truck is parked.

The LEMON LADY can't keep up!

Did you hear this one.......

a young couple walking behind me into the local supermarket.....man says 'you know you're famous?'

Preoccupied with the mental grocery list, LEMON LADY turned around, 'excuse me?'

'You're famous! Your picture is all over facebook!'

somewhat unnerving since that was never the intent.....

The ex - MR. Toyota U.S.A ATTORNEY ......A/K/A The King of Conflict who cancelled, postponed, motioned, delayed ...pretends he is a puppet merely representing a Deep Pocketed client....

A friend pointed out the sexism that has been rampant in the legal proceedings.....is the rampant SEXISM emanating from TOYOTA U.S.A.?  from ROUTE 44 TOYOTA?

Either way.....the LEMON LADY has already won!

3900 people per hour view advertising on vehicles.

Although the LEMON LADY is aging fast and the DILLY, DALLY, DELAY, STALL & BILL 'EM BOYS are doing their best to drag this out......

intent on creating a Supreme Court case out of a LEMON TOYOTA.....

...remember...this is about a LEMON TOYOTA with NO BRAKES that other TOYOTA OWNERS have complained about.

Instead of FIXING PROBLEMS, TOYOTA U.S.A. denies PROBLEMS, blames the driver and leaves TOYOTA OWNERS stuck with TOYOTA LEMONS!

PLEASE, PLEASE, PLEASE, Do your homework before you buy a TOYOTA!

Wouldn't you think....

that by now, everyone, his brother and relatives had seen my car, my truck and the LEMON LADY?

NOT SO!

Running errands, 2 women approached the LEMON LADY.

One woman got a LEMON in Florida and it took ~ 18 months to resolve in court!
Sleazy businesses shouldn't be allowed to drag out the process, IMO!

[Note: We need to change this!]

The other younger woman was on the INTERNET --- My Goodness!

All you gotta do is a GOOGLE SEARCH!

I got STUCK because I failed to do my research!

70% of NEW CAR BUYERS don't do their research for the 2nd largest purchase they'll ever make.

PLEASE, PLEASE, PLEASE: DO YOUR RESEARCH!
Research the vehicle you want to buy and the DEALERSHIP!

DON'T BELIEVE THE POSITIVE COMMENTS AND REVIEWS BECAUSE THEY MAY BE BOGUS AS EDMUNDS PROVED!

Edmonds halts fake car dealer reviews....

Everyone expresses their feelings.....

about why ROUTE 44 TOYOTA refused to correct/address the problem.....

...even more ???? about why TOYOTA U.S.A. ignored, refused to correct the problem, ignored my letters, emails, reports of the problems.....TOYOTA U.S.A. was unresponsive....

The failure of ROUTE 44 TOYOTA to resolve my LEMON TOYOTA in a timely manner allowed me to reveal ROUTE 44 TOYOTA'S ILLEGAL BUSINESS PRACTICES.

Ask yourself: Is ROUTE 44 TOYOTA a company you want to do business with?

This lists the ILLEGAL BUSINESS PRACTICES of ROUTE 44 TOYOTA: that their DILLY, DALLY, DELAY, STALL & BILL 'EM tactics allowed me to uncovered & disclose:

More Than A LEMON......

There's more than the BULLYING of ROUTE 44 TOYOTA .....

The LEMON LADY wasn't a 'customer' of ROUTE 44 TOYOTA for very long, but others have brought it to the attention of the LEMON LADY that the SERVICE ORDER gives permission to service and repair your vehicle with NO RESTRICTIONS!

It is my understanding that there is NO SPACE to include their VERBAL ESTIMATE.

So .....it costs more than the verbal estimate? YOU SIGNED IT HERE!

Maybe it's not ILLEGAL, but you just might think twice before signing!

Seems like just another SCAM!

Even with the BULLYING and THREATS.....the FIRST AMENDMENT trumps the BULLIES
like ROUTE 44 TOYOTA!

My favorite amendment is the FIRST AMENDMENT!

Settlement allows Edmunds to crack down on fake car dealer reviews

The car shopping website Edmunds.com says it has reached a settlement with an online reputation management company that Edmunds accused of submitting fake car dealer ratings and reviews on the site, Edmunds announced Wednesday.

Officials from Edmunds said they plan to share the court order with other popular sites, including Yelp, Google+ and Foursquare, where the same company may also have submitted fake reviews.
The settlement comes at a time when consumers increasingly seek out and rely on Internet reviews and other forms of crowd sourcing to find the best businesses.

In a lawsuit a month ago, Edmunds accused Texas-based Humankind Design Ltd. of registering nearly 2,200 fake member accounts on Edmunds' website to post positive but bogus ratings and reviews about 25 dealerships in an attempt to influence consumers' opinions. That was a breach of the membership agreement, Edmunds argued.

Edmunds is one of the top online resources for car prices, dealer reviews, dealer specials and tips. Employees hand screen every review, which is how the alleged fraud was discovered. Stephanie Mar, speaking for Edmunds, said Edmunds can "confidently link" 76 unpublished reviews back to Humankind.

"This is undoubtedly a victory not just for the millions of online users who rely on dealership reviews and ratings from fellow car shoppers, but also for the thousands of honest dealers who embrace authentic customer feedback," Edmunds.com President and Chief Operating Officer Seth Berkowitz said in a statement Wednesday. "We will continue to hand screen every review submitted to our site, and we will not hesitate to push back against anyone who tries to compromise the terms of our user agreements."

Asked for comment, Humankind owner Justin Anderson said in an email Wednesday, "We have not reached a final settlement, so I'm not willing to comment at this time."

In the news release, Edmunds said it's not the only site on which Humankind has been prepared to post fake reviews.

"Humankind's own marketing materials had previously identified 15 review sites on which it was prepared to post reviews similar to those Edmunds.com alleged were fraudulent," Edmunds said in the release.

In a July news release, Edmunds said Humankind's proprietor expressly promoted that he can create fraudulent reviews on ratings websites and knew it may be against those websites' policies.

"Does posting reviews ...violate terms of service...? In general, the review sites state that you must be posting for yourself and not for someone else. So in these cases the answer would be yes," the news release quotes the proprietor as saying.

On its website, Humankind advises businesses to counter negative opinions but stops short of telling people to post positive reviews instead.

"Whenever you notice that someone posted a bad review with lower ratings, you have to contact them and try to convince them to change their opinion," the website states. "Ultimately, just posting some helpful feedback on the site where the review was posted should also improve the situation."

The site does, however, mention "profile creation" as a way to drown out negative reviews. "Both free and paid profile sites can be used to post useful information and link to various relevant sites," the company states. "By posting helpful comments in forums and engaging in discussions, the useful content provided will reflect positively on your company's online reputation."

As part of the settlement, Humankind has agreed not to register users on Edmunds' site, submit reviews or participate in online discussions on the site. Humankind also agreed to provide Edmunds with information on every account Humankind registered and reviews they submitted. Humankind will also pay an undisclosed sum toward Edmunds' legal fees.

The integrity of online reviews is important because of the increasing number of consumers who rely on such reviews to decide where to spend their money.

In a Bright Local survey of consumers this year, 85% said they read online reviews for local businesses either regularly or occasionally in the past year to determine whether it's a good business.

Seventy-three percent said positive customer reviews make them trust a business more, and 65% said they were more likely to use a business that has positive reviews online.

In May, the Eater blog wrote about a business owner soliciting people on Craigslist to post fake Yelp reviews about it. In response, Yelp wrote on its official blog that its employees respond to such ads to identify who's behind the fake posts and that employees posts a consumer alert on the business' listing if there's evidence of fake reviews.

"We caught someone red-handed trying to buy reviews for this business," the alert typically states.

"We weren't fooled but wanted you to know because buying reviews not only hurts consumers, but also honest businesses who play by the rules."

Yelp also uses automated software to employ a "review filter" that examines every review and moves about 20% of the more than 39 million reviews onto a "filtered reviews" page.

"The integrity of Yelp's content is critical to its usefulness," the blog said. "Our ability to help over 100 million people a month connect with great local businesses is achieved by a combination of technological approaches (automated filtering software) and proactive sleuthing designed to smoke out the few bad actors."

Ford Pinto & Toyota's Arrogance

A friend reminded me of the FORD PINTO........

Many of you may not remember how the PINTO and the DEATHS caused by FORD's failure to correct PINTO's EXPLODING GAS TANK forced Ford to re-think their business model, become more responsive to problems and much else.

For a scant and slanted history:
Toyota is just the latest automaker to face auto safety litigation

Elsewhere I posted that the Ford/Mercury I totalled in an accident protected me, performed as it was designed, the fuel pump shut off, the car came to rest on someone's front lawn, the ABS left skid marks across the road never veering from the line of travel, among other things. The purchase of that vehicle was thoroughly researched.

I made the poor decision of not researching my LEMON TOYOTA prior to purchase.

Please don't duplicate my mistake!

RESEARCH the vehicle you intend to purchase and don't accept the meaningless fluff, such as 'State of the Art Braking System.' That means what?

RESEARCH complaints filed on NHTSA and the Center for Auto Safety. If new car owners are complaining that AIR BAGS fail on impact, how is that vehicle going to protect you?

Toyota U.S.A. bragged about the $$$$ they saved by avoiding RECALLS.
Did that serve Toyota U.S.A. car owners?

At a certain point, the arrogance of Toyota U.S.A. will deflate, just as with Ford.
It was consumers who forced that to happen.

Dear Toyota U.S.A.: More Temper Tantrums & Bullying & Sexism #4

Feelings hurt, Mr. Toyota U.S.A. generated a stack of paperwork, even sent some OVERNIGHT DELIVERY!

Phew! Mr. Toyota U.S.A. knows more methods of communication.....

Just when Mr. Toyota U.S.A. was fading....and the LEMON LADY had regrets.....you see the first time the LEMON LADY encountered Mr. Toyota U.S.A. it was windy, cold, an April morning for the NHTSA inspection .......

YES! That was the NHTSA INSPECTION of the LEMON LADY's LEMON TOYOTA

to which TOYOTA U.S.A. sent a gaggle of TOYOTA U.S.A. engineers from warm and sunny California to freeze their little butts on an April New England Morn! [Guess they haven't figured out how to access 'weather' on the internet. Note to Toyota U.S.A. : Please inform personnel about internet.]

You see, Mr. Toyota U.S.A.'s hair resembled [without the receding hairline]:

When Mr. Toyota U.S.A. appeared in Plymouth...well...you know Plymouth!

It's Wind Turbine Country! And Mr. Toyota U.S.A.'s hair kinda resembled.....

The LEMON LADY had a perverse curiosity to discern....is this a New York thing? Does Mr. Toyota U.S.A. not own a hair brush? Can Mr. Toyota U.S.A. not afford haircuts?

Please remember, Mr. Toyota U.S.A., KING OF CONFLICT, kept emailing that he was going to depose the LEMON LADY's attorney.....POOR MAN! Very confused!

On THURSDAY, AFTER 7 PM, Mr. Toyota U.S.A. sent an email.....

Attached are Notices of Appearance of Mr. & Ms. Toyota U.S.A.  as additional counsel for Defendant DMR Corp. d/b/a Route 44 Toyota s/h/a Route 44 Toyota-Scion which we have served by first class mail and have filed with the court by over-night mail. Please be advised that I will be taking the lead on Monday with respect to deposing the LEMON LADY though Mr. Route 44 Toyota likely will handle the questioning regarding the non-warranty related claims.

To which the LEMON LADY's attorney responded:

We are postponing the deposition of the LEMON LADY scheduled for Monday, October 7, 2013 at 10:30 a.m.

This short notice is a result of our opposition to the the appearance of counsel notices sent via email after 7:00 pm last night.

I will prepare a motion to strike former counsel of Toyota U.S.A.

Dear Toyota U.S.A.:

Below is an email from your Albany NY counsel.

This is BLATANT SEXISM to address OPPOSING counsel as MS. !

Not all TOYOTA BUYERS are privileged white males.

By virtue of the fact that opposing counsel is FEMALE, does that mean she's entitled to LESS RESPECT?

And the BULLYING?

FROM: Mr. Toyota U.S.A.:

Ms. LEMON LADY's ATTORNEY:

October 23rd [a previously scheduled court date] works fine for all counsel for Route 44. Please be advised that Route 44 will be filing a motion to strike plaintiff's complaint due to her continuing failure to make herself available for a deposition and today's unilateral cancellation by you of her deposition. In addition, I note that you have not responded to my previous email requesting that you provide the basis for your threatened motion to strike the Notices of Appearance filed by my office yesterday. Please consider this email as formal notice that the filing by you of a frivolous and unsupported motion will be met by a cross-motion which will seek sanctions.

Yet another Toyota U.S.A. Temper Tantrum!

REMEMBER what this is about....A LEMON TOYOTA with NO BRAKES!

TOYOTA U.S.A. has spent far more on legal fees than it would have cost to repair or replace the LEMON TOYOTA!

If you buy a new car and have problems, is this what you want to deal with?

Dismissed and Not Liking It! #3

Mr. Route 44 Toyota wakes up! [On Thursday: Not a pretty sight!].....realizes that Mr. Toyota U.S.A., now DISMISSED, is the ONLY ONE who requested a DEPOSITION of the LEMON LADY....

...immediately sends out a notice to fulfill the date the LEMON LADY agreed to ......

MONDAY, OCTOBER 7th

...well, except Mr. Route 44 Toyota includes 2 different times in his email notification that differed from the original time of 9 AM agreed to???? Huh?

THURSDAY 7PM: Mr. Toyota U.S.A. .....feelings hurt! feeling unloved....

PTC: Killing Another Forest! #5

After months of delays, sudden conflicts, cancellations and forgotten plans by the owners of Route 44 Toyota, the Brunos [with a reservation date 2 months earlier], the LEMON LADY was bent like a pretzel, forcing the cancellation of the AUGUST 6TH depositions.

Suddenly awakened!...awakened to an OPPORTUNITY for BILLABLE HOURS .... Toyota U.S.A. attorney.....sputters...spews...demands...insists on NEW dates!

...except....Toyota U.S.A. attorney, the King of Conflict, keeps insisting that he needs dates to depose the LEMON LADY's attorney!

VERY CONFUSED!

Posted here: VACATION wasn't long enough!

Deep Pocketed Clients don't really care! Competence doesn't matter.

When Big Corporations whine, lament and cry that litigation is SO EXPENSIVE....they made it so!

The King of Conflict wakes up!

Prepares a court thingey to FORCE

the LEMON LADY's deposition discussed and agreed to!

42 PAGES

A childish temper tantrum surely worth a few more BILLABLE HOURS!

Wouldn't you love to see that STATEMENT OF LEGAL FEES?

Mr. Toyota U.S.A. is careless with details and he's made other errors not commented on.....

Those 42 pages are surely taken from a previous case because Mr. Toyota U.S.A. did that with the INTERROGATORIES and his careless proof-reading skills left conspicuous errors. [Wonder what that cost TOYOTA U.S.A.]
