What kind of lawyer do I need to sue Toyota?

Personal injury Injury from defective and dangerous products Types of personal injuries Personal injury and car accidents

Cruise control would not disengage resulting in accident causing personal injuries.

James Andrew Robson

This would fall under product liability law. The most important thing to do is to make sure the vehicle is preserved and not modified, altered, or destroyed (beyond what happened in the wreck). These cases are extremely costly, so unless you have very serious injuries, it will be difficult to find a lawyer.

You might consider a personal injury attorney. Hopefully one with experience in complex litigation, including products liability. Use this website's find a lawyer feature to find an attorney to consult. Your attorney should be able to investigate your case, give you advice on how to proceed, and possibly make claims on your behalf.

Most personal injury lawyers can handle this claim for you. Call around, consultations are free and we are paid on a contingency fee meaning no up front costs to you and we are not paid until and unless you recover a settlement or judgment. These cases are sometimes a little more complicated and may require the hiring of expert witness mechanics or other experts to prove causation and failure of the vehicle. As such, most attorneys will take your case for 40% contingency fees. Any attorney in Washington can represent you.

Sticky accelerator 'caused Toyota crash'

Sticky accelerator 'caused Toyota crash'

Daniel Zatz was driving his two-year-old Toyota Aygo when he approached a junction near his home in Greater Manchester. The 34-year-old took his foot off the accelerator to allow the car to slow down.

Toyota Aygo: Sticky accelerator 'caused Toyota crash'
When Toyota Aygo owner Daniel Zatz took his foot off the accelerator it didn't slow down

"But it didn't slow down," he told his mother June. "It continued to accelerate."

Alarmed by what was happening, Mr Zatz tried to steer the car to safety. But he was unable to regain control and it crashed into the kerb where it came to a halt.

Mrs Zatz said: "It was really worrying. The main thing is that Daniel was not injured but his car needed a new tyre and rim and it could have been much worse."

Mr Zatz, a golf course green-keeper from Bury, called Toyota who said the problem was probably being caused by the 2007-registered car's floor mat catching the accelerator.

Reassured by the manufacturer, Mr Zatz adjusted the mat and carried on driving to work and back, a round trip of over 20 miles.

That was four weeks ago. But two weeks later the same thing happened.

This time Mr Zatz was able to bring the car to a halt without hitting anything, by applying the brakes and putting the car into neutral.

He called the RAC. The mechanic who examined the car said he thought the problem had been caused by dirty on the accelerator. He removed the part, cleaned it and said Mr Zatz could carry on driving the car.

He thought the problem had been solved. But last week, when he heard the news that Toyota was recalling 180,00 of its British-registered cars, including Toyota Aygos, because of concerns that the accelerators were "sticking", he became concerned

His mother June was even more worried and she called the Toyota helpline on the morning of Feb 4.

"They booked the car in for Feb 9," she said. "They want to check it first and said that the new parts are expected to arrive around Feb 10.

"Daniel is still driving it but very carefully. Toyota told him that if it happens again he should put it into neutral and use the brakes. He is worried but at least it is being dealt with and hopefully it will be sorted out properly."

Mr Katz's incident appears to contradict a claim by Miguel Fonseca, the company's UK managing director, who said on GMTV on the morning of Feb 5 that there had been "no accidents in the UK associated with this issue".

Today the company declined to comment on “individual cases” but said it stood by Mr Fonseca’s remarks.

A Toyota spokesman said: "Since November 2009 we have identified 20 cases where the sticky accelerator has been a problem but there have been no accidents as a result of this.

“Toyota has had no reports of any accidents in the UK caused by this sticky accelerator pedal issue.”

He added that “reports” referred to those made to the police or insurance companies.

The parts required for the recall are being air-freighted from Japan. Service centres in the UK will start the work by the middle of the week and will prioritise cases which may have a sticky pedal issue, the spokesman added.

Other Toyota drivers who have had problems, but no accidents, with the accelerator include Gavin Fogg, a 35-year-old photographer.

Mr Fogg, from Milton Keynes, Bucks was driving home form work at night three weeks ago when his 2007 Yaris started to accelerate. "I was in second gear as I'd just turned off a roundabout but it quickly went up to 45mph," he said.

"I was hitting the brakes but it wasn't slowing . It was really nerve-racking."

Fortunately Mr Fogg was on a straight, open road and the accelerator pedal came back up before he reached any other vehicles. "It might have been a lot more dangerous if I had been on a busy motorway or in town," he said.

Mechanics at a Toyota garage told him there was nothing wrong with the car which he bought in December for £7,300. But after the recall was announced they agreed to check the vehicle and he is waiting to book it in.
"I have to drive for my job but I am nervous about driving it until it is fixed," he said.

Another Toyota driver, Nicole James from Guildford, has an adapted Aygo, registered in 2007, said her car had "shot off the road" when the car's accelerator was "sticking."

Westwood Police Officer Niko Pieratos talks with Jack "Poppi T Clown" Erbstein at the site of a one-car accident on Berkeley Avenue on Monday. Erbstein, of Mahwah, told police he witnessed the crash, which involved another clown.

WESTWOOD — A woman who had just performed a clown show at an elementary school crashed a Toyota sedan into a utility pole on Berkeley Avenue just before noon Monday, police and a witness said.

Authorities do not know what caused the crash, Westwood police Sgt. Matthew McClutchy said. But Jack "Poppi T Clown" Erbstein of Mahwah, who witnessed the accident, said the driver was reaching for a GPS unit that fell off the windshield when she veered off the road and hit the pole.
The witness and the driver are part of Call Us Clowns, a not-for-profit organization that puts on clown shows at schools and hospitals, he said.
Erbstein said that there were about 10 clowns at the day camp at Berkeley Avenue Elementary School. The crash occurred after the show, as the clowns drove away in their respective cars.
The incident is under investigation, McClutchy said.
The driver, whose name police declined to release, is a 68-year-old woman from Fair Lawn, according to Westwood police Chief Frank Regino.
It appears she was distracted as she was reaching for something and veered off the road, he said.
Some of her clown colleagues at the scene said they had persuaded her to go to the hospital as a precaution after she initially refused.

She was transported to Hackensack University Medical Center at Pascack Valley with minor injuries, Regino said. The car suffered substantial damage.

Bicyclist Killed, 2 Injured In 2-Vehicle Crash In West Hills

CANOGA PARK (CBSLA.com) — One person was killed and two others were injured, one critically, in a two-vehicle crash Thursday in West Hills

The person killed was a female cyclist in her 40s who was standing on the sidewalk at the time of the accident. She was not carrying identification at the time of the crash, authorities said.

The crash occurred just before 4 p.m at the corner of Sherman Way and Shoup Avenue.

Investigators said a Toyota headed south on Shoup crashed into a Lexus turning west onto Sherman Way. The impact of that crash sent the Toyota onto the sidewalk, where it slammed into the cyclist.

Two other people were injured in the crash and both were taken to a hospital.

KCAL9′s Rachel Kim reported from the scene, where witnesses said they heard a horrific crash.

“It was a lot of speed in the car accident; it was quite a boom,” said Ricardo Ponzo, who lives nearby.

“Instantly, I thought I need to know who that is because I know everyone on their bikes almost,” said Ponzo. “I came over here and I saw her bike, and I just kept thinking, ‘Oh, my God.’ “

Ponzo told Kim he often said hello to the woman as they would pass each other on their bikes.

“She was a very nice lady, kept to herself. I feel sad,” Ponzo said.

LAPD investigators say the drivers involved in the accident will survive their injuries.

Detectives are trying to determine if the Toyota driver was operating the vehicle under the influence.

“Anytime we investigate a collision of this magnitude, one of the very first things we do is check for impairment. At this particular moment we are in the process of finding that out,” LAPD detective Bill Bustos said.

If you witnessed the accident, you’re asked to call the West Valley Traffic Division of the LAPD.

PR spin by automaker, law enforcement, and media in full force? Do they desperately desire the final report to say "pedal misapplication" in order to deflect from the ELECTRONICS of the computer-controlled throttle control system?

Let's see if the driver is hung out to dry publicly as so many have been in these crashes into storefronts, buildings, and homes. Jail time for drivers has been levied with nothing more than ruling out the mechanical causes. In cases of Toyota and Lexus, inconsistent and inaccurate EDR information has been used to falsely incriminate SUA crash victims. Character assassinations in the media prior to concrete evidence presentation seem to be the norm.

Are automakers nervous that the truth will be revealed publicly? Why are so many of the articles about such SUA events lacking in pertinent details, like make, model, and model year? Why aren't the exact words of the driver stated? Why is there usually immediate speculation that the driver pressed the wrong pedal? These late model vehicles are *computer-controlled*. Glitches occur often. Critical safety standards aren't strictly regulated and fail-safes have been found to be ineffective by experts in the embedded software field.

Think about how often you reboot your electronic devices. Have you considered that an electronically-driven vehicle has many of the same "glitch" issues? Are you erroneously assuming that your safety has been ensured by the auto manufacturer? Just know, the auto industry is not regulated like the airline industry. Educate yourself on this critical safety matter.

The Car Wash Association knows the truth about sudden unintended acceleration in late model vehicles, particularly Chryslers. A FastStop Car Wash just admitted that there is a list of the most common vehicles to suddenly accelerate. After an employee was thrown from a Ford Expedition as it careened out-of-control from a car wash and into a power box on the side of a building, this information was revealed by the media. In addition, Honda has just become the first automaker to address electronic throttle control software problems.

Why doesn't the public have access to the most-often-to-suddenly-accelerate vehicle list? How hard are the automakers trying to keep such information hidden? Will what you do not know ultimately put you or your family in unnecessary jeopardy? Will the PR agenda of the automakers continue to push for a "pedal misapplication" final report in these crash events?

How long will the flawed study into Toyota and Lexus sudden unintended acceleration by NASA/NHTSA be touted as a reason to blame the vehicle owners? How often will the old Audi SUA investigation be cited by online PR trolls in an effort to justify immediate incrimination of the driver victims? More importantly, how long will the public be deceived?

Why was Toyota whistleblower Betsy Benjaminson recently issued a subpoena by Toyota Motor Corporation? Is this an on-going effort by the automaker to silence the exposure of Toyota internal documents related to the electronic sudden unintended acceleration? Why hasn't Ms. Benjaminson's information been covered by the U.S. media as it has been overseas? More importantly, why hasn't the U.S. Department of Justice made reference to this information in its recent criminal investigation of Toyota? Why have we only heard about *mechanical* causes of SUA?

Something is amiss. Doesn't the public deserve to know the truth? After all, electronic sudden unintended acceleration affects everyone, not just vehicle drivers. Pedestrians and storefront occupants have been killed or maimed. Even residents in homes have been impacted. SUA events are not just occurring on the highways; they are happening in parking lots and from a standstill at traffic stops, too.

This serious problem isn't just about elderly drivers, drivers with medical conditions, or impaired drivers as a seemingly pervasive PR effort might have you believe. This is about vehicles out-of-control because of electronic glitches and ineffective fail-safes. This is about unregulated critical safety standards in complex electronically-controlled vehicles.

How come so many TOYOTAS are out of control?

Is anyone noticing that so many vehicles run into buildings, end up over-shooting parking spaces and TOYOTAS just seem to be behaving BADLY?

Has every driver become suddenly so stupid they mistaken the accelerator for the brake?

Don't ya think it's kinda curious?

TRAINS between Sydney and Newcastle were delayed today after a car crashed onto a platform and plunged to the tracks below.

Police said the 79-year-old driver may have mistakenly pushed the accelerator rather than the brake on his red Toyota Camry outside Wyong station shortly before 10am, causing the car to plough off the road and through the platform fence.

The man escaped, badly shaken but otherwise unhurt, but the car remained on the tracks between platforms 2 and 3 for several hours while crews worked out how to get it off.

However, he said there was only “minimal disruption” until about 11.30am when a crane had to be brought in, prompting the removal of overhead wires and forcing engineers to shut off power to the tracks.

“They took down the wire and so there were no trains for about an hour,” the spokesman said.

“Fortunately, being a Sunday, it wasn’t as busy as it might have been.”

People commenting on a photo of the accident posted to Facebook said the car had been parked in a five-minute drop-off zone shortly before the crash.

RSN: To Stop Corporate Lawbreaking, Prosecute the People Who Break the Law

Oh? And how about TOYOTA?

TOYOTA has injured and killed far more than those reported by General Motors.

We'll never know the TRUE toll taken by DEFECTIVE TOYOTAS because some of the lawsuits were settled with CONFIDENTIALITY AGREEMENTS ---- GAG ORDERS!

Why are we so quick to condemn General Motors when FAR more people were injured or killed by TOYOTAS?

Why are we ignoring TOYOTA?

The DOJ settlement included solely the lies by TOYOTA about the faulty accelerator pedal design.

The DOJ settlement for $1.2 BILLION, a pittance to TOYOTA sitting on $60 BILLION in cash, ignored ELECTRONIC FAILURES that TOYOTA WAS/IS fully aware of, ignored the TIN WHISKERS issue that threatens us all as TOYOTAS age and much else.

Yes! GM was wrong!

How much worse was TOYOTA and they get a pass?

These vehicles are still on our roads and we're pretending they're safe?

This is far worse corporate collusion than General Motors.

How do we ignore TOYOTAS running into buildings or KinderCare in Florida, careening into a church on Easter Sunday, speeding out of control into the Spring Valley Library, and not wonder.....?

I had the misfortune to purchase a brand new TOYOTA that led me down the path of posting TOYOTA accidents and following TOYOTAS cover-up.

Now TOYOTA is attempting to silence a WHISTLE BLOWER who exposed TOYOTA's lies.

Please educate yourselves before you condemn General Motors and wonder why TOYOTA gets a FREE PASS.

KinderCare center reopens after car crashed into building, killing young girl

ORANGE COUNTY, Fla. —
Children began returning to the KinderCare day care center on Goldenrod Road in Winter Park Monday, weeks after a car barreled into the building, killing a child and injuring several others.

Lily Quintas, 4, died in April when a car struck by a hit-and-run driver crashed through the wall of the day care as Lily and other children sat at a table waiting for afternoon snacks.

Twelve others, mostly children, were injured in the accident.

Florida Highway Patrol troopers later arrested Robert Corchado, who they said struck the car that went into the building. They said Corchado then fled the scene.

Corchado turned himself
in to authorities the following day and remains in jail charged with leaving the scene of a traffic crash involving death, and leaving the scene of a traffic crash involving serious bodily injury.

On Tuesday, KinderCare officials said they have installed reinforced concrete planters in front of the building and added traffic barriers along the sides of the building to "provide peace of mind that this won’t happen again."

ORLANDO, Fla. – A Florida man suspected of involvement in a hit-and-run car crash that killed a 4-year-old girl and injured 14 people at an Orlando-area daycare centre surrendered to authorities on Thursday, police said.

Robert Corchado, 28, turned himself in at the Orange County Jail....

Corchado is believed to be the driver of a Dodge Durango SUV that triggered the crash by rear-ending another car as it slowed to turn into the day care entrance near Orlando.

The second car, a Toyota Solara, jumped the curb before going through the parking lot and into the front of the KinderCare daycare centre, striking several children and stopping at the back of the building.

In June of 2013, I pulled into my daughter's driveway and was stopped. Suddenly my
Toyota Camry accelerated and lunged into the brick house. The cost to fix house $5000
and car $3300. LAST WEEK, I had a repeat occurrence when driving, I put my blinker on to change to R. lane,
which I did and the car accelerated and LUNGED into the car
in front of me.Both cars were quite damaged, and I again will be charged with an
accident. This car has lunged unexpectedly before but fortunately did not cause an
accident (more room). My driving record is clear except for these two unfortunate
wrecks

Toyota flunks again! Who will they blame? Another NHTSA CoverUp?

Can we expect another coverup by NHTSA similar to the Toyota Sudden Acceleration CoverUp that injured and killed so many?

NHTSA lacks the expertise and funding to accurately assess the complex software/hardware issues TOYOTA has created. Maybe it's time to call an independent expert such as Michael Barre who testified at the Oklahoma trial.

More than a year ago, I filed a Petition for Defect Investigation with NHTSA. At that time there were 30 complaints plus accidents for TOYOYA PRIUS BRAKE FAILURES.

NHTSA opens probe into brake failures of Toyota Camry hybrid sedans

2008 Toyota Camrys
Federal safety regulators will be looking into reports of brake failure in the hybrid version of these 2008 Toyota Camry sedans. (David Zalubowski / Associated Press / November 18, 2007)

The National Highway Traffic Safety Administration has opened a probe into intermittent brake failure in the 2007 and 2008 Toyota Camry hybrid sedan.

Dozens of consumers have complained to the agency about the problem, asking it to force Toyota Motor Corp. recall the cars. Toyota has previously paid record federal fines for not recalling vehicles promptly.

The agency said Monday that it would look into reports of delayed braking and brake failure from owners of the vehicle. The problem could affect up to 30,000 cars. NHTSA said it has had 59 complaints, including two reported accidents.

“When I tried to apply brakes to stop, I realized that the brake had completely failed” one driver said in a complaint to NHTSA. “I did a sharp evasive turn and hit the curb hard in [an] attempt not to run over pedestrians in the crossing!”

One Camry owner was charged more than $2,600 by a dealer to replace an actuator in the braking system. The charge was covered by an extended warranty, but the driver complained to NHTSA that it should investigate and require a recall given the number of similar complaints.

In most of the complaints, drivers said they pressed the brake pedal and experienced either a delay in response or had to put more pressure on the pedal to get the car to slow. Some reported brake failures.
Many of those complaining said Toyota was aware of the problem and should voluntarily recall the vehicles and pay for repairs.

One owner was quoted a price of $3,000 to repair the brake system.

“I am also aware that this issue is more common, especially on Toyota Camry hybrids around 5 years old,” the owner wrote to NHTSA. “It is ridiculous to have to pay 10% of my car’s original price since it is a widespread safety problem.”

Safety regulators said that about 40% of the braking incidents were occurring at speeds of more than 40 mph. NHTSA also said that the pace of people filing complaints has increased, with 55% being filed within the last eight months.

Toyota is cooperating with federal investigators, said John Hanson, a spokesman for the Japanese automaker.

“We will work with NHTSA to find out if there is a consistency here,” Hanson said. “This isn’t something that we know for sure yet what the problem is or what the fix will be. That is what this portion of the process is about.”

In late 2012, NHTSA fined Toyota Motor Corp. $17.35 million for not promptly recalling Lexus RX 350s and RX 450h sport utility vehicles because a floor mat on the driver’s side could jam the gas pedal, causing the car to accelerate when the driver didn’t intend to.

Four years ago Toyota paid a record $48.8 million in fines as a result of three separate investigations into the automaker’s handling of recalls for similar pedal entrapment problems in other vehicles, sticky gas pedals and steering relay rod problems.

Federal law requires all auto manufacturers to notify NHTSA within five business days of determining that a safety defect exists or that the vehicle is not in compliance with federal motor vehicle safety standards and to promptly conduct a recall.

[For the record, 1:59 p.m. Jan. 27: An earlier version of this post said safety regulators said that about 40% of the braking incidents were occurring at speeds of 40 mph. Actually, they said about 40% of the incidents were occurring at speeds more than 40 mph.]

Check this out...worth the read!

Verdict has Toyota runnin' scared

Not too scared of course, 'cause the Recall King can depend on a well-established network of government and industry cohorts to keep incriminating evidence quiet. Nonetheless, an Oklahoma jury's guilty verdict in a sudden unintended acceleration case is a troublesome development for T(he) O(ne) Y(ou) O(ught) T(o) A(void). The lawuit involved the crash of a 2005 Camry that left one woman dead, another seriously injured.

How many more injuries and deaths will Toyota owners suffer before this is corrected?

Woman Claims Her RAV4 Accelerated Into a Brick Wall
NBCPhiladelphia.com
Elizabeth Bagnell's RAV4 crashed into a brick wall Tuesday. She says the car accelerated on it's own.

Mere hours after two Toyota Prius owners said their cars sped out of control, a Montgomery County woman claims it happened to her.

Elizabeth Bagnell and her brother Steve were pulling into a parking spot at a King of Prussia medical office complex Tuesday afternoon when she says her Toyota RAV4 accelerated on its own and into a brick wall.

"I start to give it some gas pulling into the parking spot and I can hear the engine rev," Elizabeth said.
The Hatfield, Pa. woman says the next thing she knew, the car was careening towards the wall.

"It sounds almost like, if you're just, standing on top of the gas pedal," Steve recounted.
Elizabeth said she slammed down on the brake pedal, but the car just wouldn't stop and even after hitting the wall, the wheels just kept spinning.

"She had turned off the car, but I'm shoving my door open and the wheels are still spinning," Steve said. He says it took him putting the car into park to get the wheels to stop.

The SUV's airbags did deploy during the accident, but the two weren't seriously injured. Upper Merion Township Police are calling Bagnell's accident minor and haven't confirmed an accelerator pedal issue, but the siblings say Elizabeth wasn't at fault.

Bagnell's accident is just the latest in a series of new Toyota acceleration claims across the country this week.

A California man says his 2008 Toyota Prius wouldn't slow down after he passed a car on a highway Monday. He spent 23 minutes hurling down the road and was forced to call 911 for help.
State Troopers say they watched his brake lights come on as he tried to slow, but the car wound't stop.

On Tuesday, a New York woman says she was backing out of her driveway when her 2005 Prius shot across the street and into a stonewall.

And in eerily similar case in Southern Massachusetts, an elderly woman's 2010 RAV4 crashed into a medical building Tuesday. The 70-year-old driver told our Boston affiliate WHDH that her foot was still on the brake after the accident.

Both Prius models were not included in Toyota's massive recall from earlier this year, but the 2010 RAV4 was listed. The elderly woman told WHDH she had brought her car into the dealership to have the gas pedal serviced. Officials are investigating all three cases.

In the wake of these latest claims of car trouble, Toyota released this statement to CNBC's Phil LeBeau Wednesday night:
We've launched a top-to-bottom review of all our operations, led by our President Akio Toyoda, to ensure that we not only meet but exceed the high safety standards that have defined our company. Consistent with that review, we will ensure that our customers' voices are heard and acted upon in a timely manner.
We are committed to investigate customer concerns more aggressively by deploying teams of technical specialists to conduct on-site inspections of verifiable unintended acceleration claims as quickly as possible.

Elizabeth's 2008 RAV4 model has not been recalled. She says she called her dealer after the February recall was announced, but was told her car wasn't affected. She also says she's never had a problem with the SUV before.

"I'm just wondering what they're going to do about everything," Steve said. "If they are gonna, you know, do a mass recall, obviously wasn't her year and it was."
