Middleboro BOS: Misplaced Indignation #2

On February 9, 2009, the Middleboro Board of Selectmen finally addressed questions that have been raised regarding personal relationships and contact with the Mashpee Wampanoag Tribe and other related parties.

Note Mrs. Duphily's declarations of her availability during the days and at Selectmen's Meetings and the failure of people to ask her questions.

One of the reasons the Town of Middleboro has gotten mired in muck is because of backroom deals, private meetings, lack of public discussions and violations of the Open Meeting Law and Ethics Statutes. Mrs. Duphily was probably not paying attention during that period of time.
.
Mrs. Duphily's public comments fail to provide any explanation about why Helen Belmont was in her office, speaking with Stephen Graham.
.
These issues needed to be addressed in public and on the record. Unfortunately,
it is unclear what Mrs. Duphily asked Town Counsel. Was it merely the wrong question to obtain only an answer that satisfied her, but failed to resolve the matter, much like her question about participating in Fire Dept. matters? Why are we running up Town Counsel's time for matters that could be resolved by Mrs. Duphily simply reviewing the Ethics Commission web site?

This isn't about a cheap mug and tshirt given to her by the Tribe, but more about Mrs. Duphily not even questioning if receiving gifts might be a legal issue.

This isn't about a Conflict of Interest, but about inappropriately socializing with a business partners who come before the Board, without questioning doing so.
.
As a point of information, the matter of the Mashpee Wampanoag letter to the Governor transpired in September 2008.

Should I feel comforted that Mimi and Spatero are handling our budget crisis when Mimi looks like a deer in the headlights and Spatero didn't know excise taxes went into the town's coffers?
Can't we do better?

It seems Mrs. Duphily is using a lot of Town Counsel's time for issues that she could investigate herself or could attend free seminars offered by the state to understand. Her actions jeopardize the town.
I've already filed with ethics to have them consider her participation in fire dept issues and mailed a letter tuesday about what you raised here.
Nice lady who shouldn't have run for office.

What Mimi did was wrong.
Town business should not be conducted in private.
NO ONE should discuss in private the way she has conducted town business.
It's in violation of Open Meeting Law and other things.
No one should have been put in the position of apologizing.

Someone posted that Mimi's house was broken into and some comments have been removed.

Why?

Criticism of Mimi on her conduct as a Selectwoman has nothing to do with her personal matters.

She was offended at phone calls from reporters. Part of the job, I'd think.

Don't like the heat? Get out of the fire. Simple.

People keep questioning her Fire dept issues, why doesn't any one care that a certain person was promoted to captain, after all, he is married to the ex wife of the interim, and is his friend. Why does he have a white fire department vehicle with no logos on it parked in his driveway just about every day> what does he actually do? Years ago there was a chief who had a son on fulltime and one on the call, but he could set the pay scale for the callmen?
no conflict? I mean people get your head out of the sand. Start listening and looking around town, see who is getting ahead and why?

fire department? How about Spatero comenting on how wonderful it was that the f.d. arrived twice for relatives ahead of AMR? The man's too dumb to realize that theyre dispached from the same place by the same dispacher. Its a waste of town money. sounds like alot of coruption that spatero ignores. He's like an alien who doesnt see what goes on around him.

A competent IT Director might consider streaming video of BOS meetings and all of the other town depts to reveal the workings of goverment to residents so they could watch the whole meeting. The current IT director is on the cable comitee. Nuff said.

If he cant improve the towns web sight what can we expect? When his wife doesnt know the diference between emails, blogs, websites she needs to be replaced by someone with a brain.

The rest of the board is equaly uninformed.

If they dont provide information, you wont ask questions. Cristelo is a disapointment.

Mrs. Duphily owes both townspeople an apology for her rude treatment of them.

Personal attack? Please! The way in which you conduct town business isn't personal.

Mrs. Duphily, this is not Sunday Tea or a social event. You need to inform yourself of the laws that govern your conduct. The poster who signs as Smoking Owl is correct. You're in over your head. You might want to consult your personal attorney.

Does anyone know what Mr. Cristello is
allowed to do? Remember the BOS set the
policies of who and how he gets involved
with, unlike the last town manager who
thought he was president of the town,,and got his hands in every inch of
the place? Lets give the guy a fair shake until we find out how much power or non power he has in his position.

Mimi, Dear,

In my opinion, you were insulting the Mr. Fraley and you need to apologize.

It was inappropriate of you to insist that he address issues with you in private. This is a town meeting form of government and you are an elected official. You need to answer questions posed by voters in public and on the record.

Mimi, Dear, Mr. Spaturo returned those cheap gifts to the Tribe because someone else told him he should. You should return yours as well. You need to stop being defensive about your inappropriate conduct. You were wrong on the Fire Chief matter. You continue to participate in other matters pertaining to the Fire Dept. that you shouldn't. You are wrong on these matters pertaining to the Tribe. You need to adhere to the law and stop scolding voters who ask for a public answer from you.

This matter wasn't a personal attack. It was about your questionable conduct that is in violation of the law.

You need to stop insisting that people contact you for a private explanation of your public conduct. That's not the way it works.

I am personally offended by your conduct when answering the questions that were raised. This isn't Romper Room.

I'm watching your conduct and it is unacceptable to me. You are an elected official who needs to respond in a public forum.

You need to apologize and stop arguing with those who inform you that you are violating the law in your conduct.

Is your intent to stop citizens from asking questions about your conducting town business in secret? It seems so and that is worrisome.

You never attended town meetings or selectmen's meetings before you were elected. Your ignorance shines through. You chose to run and got elected. You need to conduct yourself appropriately.

Why does the town even have an ambulance if AMR has the contract? Town employees seem to have decided that the town will have an ambulance service regardless of the Matrics report. This seems like a waste of money. It could be a good place to start cutting costs.

Don't worry, things could have been worse. The interim probably tried to pull his exwife's husband into the chiefs spot. He found out he couldn't pay his past debt off that way. Such a pity. Thanks to the newly appointed captain that has really no job description was at the time a selectman that got his wifes exhusband the new chief of police. ALL IN THE FAMILY?? Again, why is that town owned vehicle always at his residence? Because HE CAN. According to the police chief he said they can take vehicle home for lunch. So how long is lunch time????

BTW, where's the town's vehicle use policy posted on the PTWS? You have to ask for a copy if you want it. BTW, there's not supposed to be smoking in town vehicle. Why do I see it?

So means any firefighter can take the truck home and sit in his driveway for lunch? Wiksten must have early dinner also, cause he leaves real early each day? I guess he is just so qualified, NOT!! I hear in the interim put him on the EMS committee, Not bad, he never applied himself to become an EMT> also
was on new truck committee. I wonder if those jackets were a part of the deal? How much did the town pay for those for the the 4 buddies? Did anyone ever see the bids for the new monster truck? I think you are a called a firefighter, when you actually go and fight fires. I hope this new chief has a big broom with at least 5 strong bristles to sweep to the curb!!!

I'm still trying to figure out how the department got approval to replace the pump in the old engine. We were told there is and always was a licensed mechanic on duty as a firefighter. I believe the records from Plymouth show with the retired firegighters titles that has not been the case for the past twenty or so years. Again, truth? No just no follow up investigating. All hear say and their word is golden. No one challenges anything from department heads showing proof. This from my understanding was did wrongfully and could have cause more damage to the already existing problem. But they claim they saved the town money. How do you figure that one? Can someone look into this and prove us wrong? Again, too little too late.
