8th Circuit upholds verdict, $11M award for Koua Fong Lee and victims in Toyota Camry crash

8th Circuit upholds verdict, $11M award for Koua Fong Lee and victims in Toyota Camry crash

A three-judge panel of the 8th U.S. Circuit Court of Appeals has unanimously upheld the verdict in favor of Koua Fong Lee, the St. Paul man who sued the Toyota Corp. after he lost control of his Toyota Camry in 2006, resulting in the deaths of three people and his imprisonment.
In a 2015 trial, a jury found Lee 40 percent at fault and Toyota 60 percent at fault for the collision and awarded Lee and other crash victims $11.4 million.
The panel concluded that the evidence and testimony presented at trial gave a plausible explanation for Lee’s contention that his 1996 Camry accelerated while he tried to apply the brakes as he exited eastbound Interstate 94 at the Snelling Avenue exit. The Camry rear-ended a 1995 Oldsmobile Ciera, killing the Ciera’s driver and his son, and injuring the driver’s daughter, who died 16 months later, and two other relatives in the car.
Texas attorney Bob Hilliard, representing Lee in the trial in U.S. District Court in Minneapolis, argued that the accelerator stuck as a result of a manufacturing defect by Toyota.
Toyota appealed, saying U.S. District Judge Ann Montgomery improperly allowed irrelevant testimony at the trial. Three witnesses who testified that their 1996 Toyota Camrys inexplicably accelerated should not have been permitted to testify because their circumstances were different, the company argued.
The appeals court ruled that the jury listened to conflicting testimony and reached a reasonable conclusion.
“The jury’s verdict was not based on ‘sheer speculation,’ and instead is supported by reasonable inferences drawn from the plaintiffs’ evidence.
On one point, the appeals court said that Montgomery erred in awarding prejudgment interest to the mother of Devyn Bolton, the girl who died later from her injuries. It was not immediately clear from the appeals court decision, how much money that would entail.
Hilliard’s law firm said the $11.4 million verdict was the largest for sudden, unintended acceleration ever issued against Toyota.
Before the civil trial, Lee spent two years in prison after Ramsey County prosecuted him for the accident and a jury convicted him of criminal vehicular homicide. Hilliard won Lee’s release after presenting evidence that Toyota Camrys had a history of sudden, unintended acceleration. County prosecutors decided to not retry the criminal case.

Release of Koua Fong Lee

ABC NEWS: Toyota Driver Koua Fong Lee Released from Prison; No New Trial for Deadly Crash
CNN NEWS: Minnesota Judge Frees Minnesota Man
WCCO NEWS: Judge Frees Koua Fong Lee...Charges Dismissed

The Koua Fong Lee Story

Koua Fong Lee came to America with his family from a Thailand refugee camp in 2004, looking for a better life and an education. Instead, Mr. Lee has been serving an 8-year prison sentence for criminal vehicular homicide, following a 2006 car crash that killed three people.

Koua Fong Lee was returning home from church on June 10, 2007. He was driving a 1996 Toyota Camry. His pregnant wife sat beside him. His 8-year-old daughter, his brother and father sat in the backseat. He was traveling from Minneapolis to his home in St. Paul. The radio was off and he was not talking on a cellphone. He exited I-94 eastbound onto the Snelling Avenue exit ramp traveling at 50-55 mph. He took his foot off the accelerator and applied the brake as he approached the intersection of Concordia and Snelling Avenues. The brakes did not slow the Camry. Mr. Lee yelled to his family ”brakes not working!”

Mr. Lee continued to pump and press the brake pedal. The Camry would not slow but instead continued to accelerate. He moved from the most left lane of the ramp to the center lane, avoiding vehicles traveling in front of him. He then moved from the center lane to the far right lane of the ramp to avoiding hitting other vehicles traveling and stopped on the ramp. Mr. Lee continued to pump and press the brake pedal during these maneuvers. The was no place for him to go as he approached the intersection. The signal light was red and cars were stopped at the intersection. One was stopped in the far right lane and the other about two vehicle lengths off the intersection in the center lane. Mr. Lee observed a space between the two stopped vehicles. He attempted to negotiate his vehicle through the space. As he split the two vehicles, he sideswiped the vehicle in the center lane. The force of the initial collision redirected his vehicle into the rear driver-side of the second vehicle stopped in the far left lane. Mr. Lee's Camry recoiled back from the collision and then accelerated forward across the intersection of Snelling and Concordia. Mr. Lee struck the rear driver-side of another vehicle that was traveling northbound on Snelling. Mr. Lee's Camry came to rest against a fence across the intersection. Two people in the second vehicle struck by Mr. Lee's Camry died at the scene and another young girl died a year and a half later. Three others were seriously injured.

Investigators calculated that Mr. Lee's car was traveling 70 to 90 miles an hour when it slammed into the back of a stopped Oldsmobile, instantly killing Javis Adams, 33, and his 10-year-old son, Javis Adams Jr. Another passenger, 6-year-old Devyn Bolton, died from her injuries more than a year later.

After examining the vehicle, a mechanic found nothing wrong with the brakes. Prosecutors argued that Lee stepped on the gas, not the brake, and a jury agreed, convicting him of criminal vehicular homicide and sentenced him to 8 years in prison.

Lee fired his attorney following his conviction and retained Minneapolis Attorney Brent S. Schafer to represent him at the sentencing phase of the case. Schafer filed extensive documentation with the judge who would be sentencing Lee. Schafer requested and argued that Lee serve only 1 year in jail rather than several in prison, as required by Minnesota law. Following a lengthy sentencing hearing, the Judge disagreed with Schafer and sentenced Lee to spend 8 years in prison.

Attorney Brent S. Schafer says his client has always focused on the brakes as the problem. "He could only explain what happened in that he tried to apply the brakes and it didn't work and that the vehicle would only accelerate up the ramp," Schafer said.

In January of 2010, Schafer reopened the Lee case after numerous Toyota recalls for sudden unintended acceleration (SUA). Schafer teamed-up with a well known products liability attorney, Robert Hilliard of Corpus Christi, Texas. Together Schafer and Hilliard promised Lee that they would do whatever it took to gain his release and a new trial. Schafer soon discovered that Lee was not the only owner of a 1996 Toyota Camry that had accelerated out-of-control.

After Lee's story was reported in newspapers and news programs such as CNN, MSNBC, Good Morning America and World News Tonight, Schafer was flooded with letters, e-mails and calls from people all over the country who had experienced the same SUA as described by Lee. Schafer said, "It was at this point in time when I was absolutely convinced that there was an innocent man in prison."

This was a defective prosecution caused by a defective car." Schafer collected affidavits from over 50 late-model Toyota drivers throughout the United States, each one describing an experiencing during which their Toyota would accelerate out-of-control.

In April of 2010, Schafer and Hilliard filed a Petition for Post Conviction Relief seeking a new trial for Lee based upon the new evidence of SUA, the ineffective assistance of trial counsel and improper/wrong expert testimony during trial. In July, a Ramsey County District Court Judge granted Lee's request for a hearing to determine whether he was entitled to a new trial. The hearing was scheduled to begin on August 2, 2010.

On Tuesday, August 3, 2010 during the second day of an evidentiary hearing, two more victims of sudden acceleration testified that their vehicles sped out of control just like Koua Lee’s 1996 Toyota Camry. Expert witnesses also testified about important key facts -- reasons his lawyers say Koua Lee should be given a new trial. “From the moment Lee stepped out of the vehicle and was interviewed by the police officer at the scene he said he was pushing the brakes,” said defense attorney Bob Hilliard. “He said that through trial and his lawyer stood up and told the jury the exact opposite.” In the original trial, his attorney told a jury that Lee may have simply been confused. That he mistakenly pressed the gas when he thought he was hitting the brake. But Lee never gave his attorney permission to make that statement. “This is your lawyer telling the jury that you’re wrong,” said Hilliard. “That his client is wrong,”

Samuel Sero, a forensic engineer testified that Lee’s Toyota Camry was equipped with ABS brakes at the time of the accident. But the jury that convicted Lee of criminal vehicular homicide was told the car did not have anti-lock brakes. “That’s a big deal because they had to show the brakes were functioning properly so they put on testimony that Mr. Lee’s brakes were working and he said he was braking. If that was true he would have stopped.” Hilliard says, that would explain why there were no skid marks at the scene. A technical witness who inspected the car back in April testified the tail lights showed the brakes were being applied at the time of the crash. “Everybody, even the state’s experts agree that light, when you look at it today right now, shows that the light was on at the time of impact,” said Hilliard.

On August 5, 2010, the morning of the final day of the trial, the Ramsey County Attorney offered to release Mr. Lee and allow him to go home. However, the County Attorney would not agree to reverse the convictions and give Mr. Lee a clean criminal record. Accepting the offer would return Mr. Lee to his wife and four children but he would arrive back home a convicted felon on probation for nearly 15 years and a person not eligible for a driver's license for the next 10 years. Mr. Lee declined the offered. Later that day Lee sat quietly and watched Schafer stand before the Judge and lay out in detail the new evidence and other legal reasons that entitled Mr. Lee to a new trial.

At approximately 5:00 p.m. on August 5, 2010, in a highly anticipated decision by a Ramsey County, Minnesota Judge, Koua Fong Lee was granted a retrial and released from prison! Later that day, the Ramsey County Attorney announced that they would not be retrying Mr. Lee.

Toyota Lies about Plastic Pulleys that caused Deaths!

The people were killed because of TOYOTA'S Defective Design:

And TOYOTA LIES? [see comments below]

Trudy Baltazar authored this book to document the fight of strangers to free Koua Fong Lee:

Ms. Baltazar is in the courtroom documenting the trial against TOYOTA and has been commenting elsewhere.

Update of courtroom activity on Thurs., 1-15-15

A toyota employee gave a deposition on 12-4-14 (they showed the dep in court for us all to see) stating heat tests were conducted on these 2 plastic pulleys which have been proven to be defective when exposed to a certain degree & amount of heat.

The pulleys are part of the throttle body and they control the accelerator cable. When the upper pulley is working properly, the pulley will release the accelerator cable when one takes their foot off the gas. I think I mentioned yesterday the expert mech engr who heated the pulleys to 165 deg and the top pulley that the accelerator cable goes into binds up against the metal bracket it’s up against and won't release the accelerator cable. It appears the pulley gets stuck to the metal bracket/plate.
It took ~7 mins for the pulley to cool down and release the accelerator cable. Well in the toyota deposition, this employee of 40+ yrs stated that they had heat tests done on these pulleys for 8 days @ 248 deg F. This expert for the plaintiff’s used a hair dryer for 30 mins and got the pulley to heat up to 165 deg and the pulley wouldn't function properly at that temp. Well 3 weeks before toyota employee gave the deposition, they learned that the heat tests on the plastic pulleys had NEVER been conducted!

Three weeks later this toyota employee swore in a deposition that the tests were done. In cross examination, the toyota lawyer asked the expert John Stilson, "did you take the 1996 Camry for a drive and hook up monitoring equipment to the pulleys and the metal bracket to see in real life situation if the pulleys were heating up due to real driving time? Expert's answer, "no, because I wanted to follow toyota test specification". cross examination ended not too long after that.

Turns out it’s in toyota’s own 1996 Camry owner’s manual that (paraphrasing here) ‘If you need to conduct a test to see if a part is malfunctioning due to heat, use a hair dryer’ and they even show a picture of a hair dryer.

TOYOTA RAV4 crashed into restaurant, 10 hurt, 1 critical

Media Judge and Jury have already decided:

BLAME THE DRIVER!

This time the MAKE AND MODEL is included in the article, in addition to the DRIVER'S AGE.....

Yup! Gotta be DEMENTIA! How could it ever be the fault of TOYOTA and TOYOTA'S faulty electronics?

10 Hurt, 1 Critical After Vehicle Crashes Into Little Caesars

PACOIMA (CBSLA.com) — Ten people were reportedly injured, at least one critically, when a vehicle crashed into a Little Caesars pizza restaurant in Pacoima Monday afternoon.

The incident occurred shortly before 6 p.m. Monday, at the 12700 block of Van Nuys Boulevard near the intersection of Glenoaks Boulevard.

A white Toytota Rav4 crashed into the restaurant through the front window.

Los Angeles City Firefighters arrived on scene to treat injuries minutes later.

Three of the injured victims were children, who were transported to the hospital after being secured on stretchers. Seven other adults also suffered injuries.

The critically injured victim is a five-year-old girl.

“It was just a big ‘bang’, and it was unreal, it was outrageous,” one witness said. “It was just people scattered everywhere.”

It was not clear how many injuries may have been related to broken glass.

“It was horrible,” the witness said. “It was something I’d never seen before in my life. It was just horrific.”

When firefighters arrived on the scene, the vehicle was idle and completely inside the restaurant, where structural damage is said to be minimal.

LAPD arrived on the scene as well, where an investigation into the crash continues.

The driver, a 60-year-old woman, also had two children inside her car, who did not suffer any injuries.

Police say the driver hit the gas pedal instead of the brake.

“We’re investigating the cause of the collision, and whether or not there was any impairment on the part of the driver,” LAPD Capt. Maureen Ryan said. “We don’t have that yet.”

The driver had not been cited as of 10 p.m. Monday.

Four attorneys from Beasley, Allen, Crow, Methvin, Portis & Miles, P.C., have been selected as finalists for the 2014 Public Justice Trial Lawyer of the Year award for their work on litigation related to Toyota sudden unintended acceleration. Nominees Jere L. Beasley, J. Cole Portis, R. Graham Esdale, and Benjamin E. Baker of Beasley, Allen, Crow, Methvin, Portis & Miles, P.C. in Montgomery, Ala., and Larry Tawwater of The Tawwater Law Firm in Oklahoma City, Okla., and Paul Martin of Martin Jean Jackson in Ponca City, Okla., led the charge against Toyota on behalf of the Bookout and Schwarz families. Bookout v. Toyota Motor Corp. was the first suit to go to trial against Toyota tying sudden unintended acceleration to electronic throttle control problems.

When thousands of Toyota Camrys were suddenly accelerating, the company reacted by blaming the incidents on individual parts of the car: first floor mats, then sticky pedals. But, according to Toyota documents and testimony before Congress, these problems only accounted for 16 percent of the sudden unintended acceleration complaints. The problem was actually bigger: the software in the Toyota Camry that controlled the electronic throttle system was poorly designed and did not conform to industry standards. One of those Camrys that suddenly accelerated was Jean Bookout’s. She was injured and her passenger Barbara Schwarz was killed in a September 2007 crash.

The jury’s October 2013 verdict in this landmark acceleration case — awarding $3 million in compensatory damages and finding that the plaintiffs were entitled to punitive damages — not only led Toyota to settle the case for a confidential amount before the jury could determine the amount of punitive damages, but caused Toyota to try to reach a global settlement of the hundreds and hundreds of cases pending in multidistrict litigation proceedings.

The Public Justice Trial Lawyer of the Year award honors attorneys who take great risk and overcome incredible odds to advance the common law, to make new law, and to win justice for their clients and for the common good of the public.

Also nominated was Lance Cooper of The Cooper Firm in Marietta, Ga., for his work on the Melton case, which uncovered GM’s defective ignition switch and prompted a massive recall and sparked a congressional investigation into the automaker’s conduct. All the nominated attorneys were recognized at the annual Public Justice gala at the American Visionary Art Museum in Baltimore, Md., on July 27. For more information, visit www.publicjustice.net.

Toyota Recalls.....

FYI....

Toyota recalling 1.9M Prius models globally for software update

Toyota has announced a set of voluntary recalls covering 960,000 Prius, RAV4, Tacoma and Lexus RX350 models in the United States to address two separate issues. Worldwide, Toyota will have to recall a total of 1.9 million Prius cars.

The Prius recall affects about 700,000 2010-2014 models in the US, due to a fault in the motor/generator control ECU and hybrid control ECU software. It says that the current software could result in high temperatures on certain transistors and possibly damage them. When it fails, the error forces the car into failsafe mode. Toyota says that in rare circumstances, it could even shut the hybrid system down while the car is being driven.

Toyota spokeswoman Shino Yamada told Automotive News that the software update should take about 40 minutes, and dealers would start to be notified about affected vehicles today. She also told them that the first reported glitch occurred in May 2011 in the US when the system overheated and the car entered failsafe mode. The affected cars were built between March 2009 and Feb. 5, 2014, according to Automotive News. Toyota says that it has received no reports of accidents or injuries caused by either fault.

This is the third major recall for the third-generation Prius. In February 2010, Toyota recalled the model to fix an anti-lock brake software glitch, and in June 2013, cars were recalled in the US to fix the brake pressure accumulator.

The second recall affects 260,000 2012 RAV4, 2012-2013 Tacoma and 2012-2013 Lexus RX 350 models due to an electronic flaw that could cause the Vehicle Stability Control, Anti-lock Brake, and Traction Control functions to intermittently shut off. Scroll down for Toyota's full announcement.

Report: Toyota must go to trial over unintended acceleration suits

Toyota is surely readying its trial lawyers, as the Japanese giant is officially headed to court in a pair of cases relating to its unintended acceleration fiascos of 2009 and 2010. In the first case, the United States Supreme Court has actually got involved in matters, ignoring an appeal from Toyota that attempted to use an arbitrator to settle its ...

Toyota PriusReport: Toyota documents show knowledge of defects in 2006

Documents that were submitted by Toyota to the National Highway Traffic Safety Administration in March and obtained by Automotive News reportedly show that Toyota knew of dangerous safety defects on its vehicles as early as February, 2006. The first documented issue was of a 2005 Toyota Prius that experienced floor mat interference with the accelerator. ...

Class Action Lawsuit Against TOYOTA for Engine Failure

The article below offers an analysis of TOYOTA's organizational failures. Further down, is information about CLASS ACTION because of TOYOTA's Engine Failures.

The TOYOTA engine failures transpired from 2006-2011 - a 5 year period during which TOYOTA remained unresponsive to consumer complaints.

Toyota Recall Highlights Deep Organizational Failures

Akio Toyoda, President and CEO of Toyota Motor Corporation

When Toyota Motor halted sales of eight models in the United States because of potentially fatal sudden acceleration problems, industry pundits were quick to cite Toyota's rapid expansion into the States as the key culprit. Toyota established factories in five U.S. states in the late 1980s, but about five years ago it began ramping up production and making big expansion plans as a way to meet soaring demand and, ultimately, to grab the title of world's largest automaker from General Motors. This strategy — which spread its U.S. manufacturing operations across several states — was a clear break from Toyota's practice of concentrating its suppliers and plants in a narrow geographic area to allow better control. Because of its hasty ambition, Toyota developed a problem coordinating just-in-time arrivals from its suppliers and maintaining deep technical ties with those suppliers.

But that's only part of the story. The roots of Toyota's problems — and there are several — run much deeper. They include:

Bureaucracy

The lines of control of Toyota’s U.S. operations were murky. During most of Toyota’s expansion into America, the company’s California-based sales division and its Kentucky-based manufacturing division reported back to Japan, independent of each other. For a few years, the company’s top-ranking U.S. exec, James E. Press, was able to establish Toyota Motor North America in New York as the de facto headquarters in charge of all U.S. operations. He even rose to become the only American on Toyota’s board of directors in Japan. But Press quit in 2007 to join Chrysler and he was replaced by a series of Japanese executives with less clout. With Press’ departure, Toyota lost its key bridge between management in Japan and various U.S. constituencies — and its ability to respond rapidly when crises hit.

Overconfidence

Another underlying problem is cultural. Toyota is a secretive and non-communicative organization.

American insiders joke that working for the company is like working for the Central Intelligence Agency, where information is shared only on a “need to know” basis, confides one American employee. And long a scrappy underdog to General Motors and Ford Motor, Toyota developed a sense of cockiness in the past two or three years as it began to surpass its American rivals in global sales. The company did not need rebates to sell its vehicles. Consumer Reports gave the brand high praise. Toyota did not believe it needed a strong public relations effort. The company thus failed to recognize that the pressures on the No. 1 player in any market are far more intense than the pressures on No. 2 and No. 3.

Weak Management

For years, the company has been led by a series of world-class professional managers. Then last summer, Akio Toyoda, 53, grandson of the company’s founder, took charge as chief executive and some insiders did not think he was ready, say some auto industry watchers in Japan. They were right.

When he took the job, Toyoda told the world that he would practice “genchi genbutsu,” which translates roughly as “management by walking around” or “going to where the problem is.” But when the safety flap came to light, he remained silent and even attended the annual gathering of world leaders in Davos, Switzerland. American crisis response experts were flabbergasted. “What is he doing in Davos anyway?” Paul A. Argenti, a professor of corporate communications at Dartmouth’s business school was quoted as saying in The New York Times. “If you’ve got a crisis of this magnitude, you get on a plane and you go to the scene of the problem.” Instead, day-to-day management of the controversy was delegated to James E. Lenz III, head of Toyota Motor Sales.

One of the biggest mysteries is this: Why hasn’t Toyota still not gotten to the bottom of what went wrong? The company is famous for inventing the practice of asking “the five whys.” This was a rigorous methodology that permeated the company’s culture: If a car had a problem, why? Was it a supplier? If so, why did the supplier have a problem? And so on. This practice for decades has allowed Toyota to respond to problems better and faster than General Motors and Ford.

The Fallout

Toyota’s problem-solving mechanism clearly broke down. The company revealed as much in the series of explanations it released. Initially, Toyota announced the floor mats were the problem. Then it was the gas pedals, which were made by an Indiana-based supplier and thus limited the problem only to U.S.-made cars. But that story didn’t hold up because of a well-publicized case involving a Lexus in California in which four people died — and that vehicle was made in Japan. Then in early February, problems developed with the Prius hybrid and its brakes in both the U.S. and Japan. Toyota described it as a software issue.

Now it seems the underlying problem involves the software and the computerized controls governing acceleration and braking in many Toyota vehicles. No one knows for sure but this series of problems could take months to reformulate. New safeguards may have to be put in place. It will not be a quick fix, as Toyota originally suggested.

CEO Toyoda has only compounded the crisis. When he finally held a press conference in Japan to apologize, he pointedly did not make a deep bow to demonstrate regret. In Japanese cultural terms, Toyoda’s bow was perfunctory. Moreover, his proposed solution — to create a global quality committee and seek advice from outside experts to evaluate Toyota’s operations fell spectacularly flat. He did not appear to understand what had gone wrong inside his own company, much less have a concrete way to address it.
The Toyota Toyopet. Photo courtesy: Flickr/Hugo90

Toyota used to have a reputation for quickly correcting mistakes. It first introduced a vehicle nicknamed the Toyopet in the U.S. in 1957. It was laughed out of the market because of its ungainly design and small size. But by 1959, Toyota was back and it executed flawlessly in the United States for 50 years, even introducing the luxury Lexus brand, which beat Mercedes, BMW and Cadillac in total sales.

Now it faces class-action lawsuits and intense scrutiny from Congress and officials at the National Highway Traffic Safety Administration. The tone is reminiscent of the Big Tobacco hearings more than a decade ago: What did Toyota know and when did it know it? There’s no question that Toyota’s reputation has been badly damaged. The only question now is how long it will take to recover.

William J. Holstein has been following Toyota since 1985. He published “The Japanese Power Game” in 1990. His most recent book was, “Why GM Matters: Inside The Race To Transform an American Icon.”

Toyota Vehicles. Owners/lessees of various model year 2006-2011 Toyota vehicles should be aware of the manufacturing defect described below. The problem may impact both (1) current owners and lessees of these vehicles and (2) former owners/lessees who no longer own these vehicles but incurred out-of-pocket expenses in repairing damages arising from the defect. Class Vehicles use a common 2.4L 4-cylinder short block engine. Our investigation indicates that a subset of the engines was manufactured by an unidentified supplier that failed to manufacture the engines’ piston rings to specifications. Due to this defect, a subset of Class Vehicles will eventually begin to lose oil through the rings’ oversized openings, causing engine parts to “grind” and, eventually, the engine to seize. Necessary repairs may include an engine overhaul, component replacement, or, total engine replacement costing upwards of $8,000. Vehicles that may be affected include these Vehicle Descriptor Section (VDS) numbers. (Vehicle Descriptor Section numbers are the 4th-8th numbers of your car's Vehicle Identification Number-VIN).

Dear Mr. Akio Toyoda:

I once believed Toyota had a long and proud history of integrity and quality. Now I'm not so sure.

Watching you testify before Congress was touching!

Mr. Toyoda, you almost appeared sorry that Toyota vehicles had killed and injured so many.
At times, you appeared almost ready to cry.

Since I purchased a BRAND NEW TOYOTA LEMON, I've become a cynic.

You were well-coached! You have left me wondering if you were only distraught because you got caught breaking U.S. law and the cost would be high.

Evidence, documents translated from Japanese, seem to indicate that TOYOTA in JAPAN KNEW about the cause of TOYOTA SUDDEN UNINTENDED ACCELERATION and failed to protect YOUR customers.

You might find this contradicts your public statements:

Toyota Whistleblower

After killing and injuring so many, I believed you had corrected the problem.

Complaints made by NEW TOYOTA owners indicate you have NOT.

More egregious, is that when a NEW TOYOTA OWNER complains to Toyota U.S.A., they're ignored or dismissed.

Mr. Toyoda,

My BRAND NEW TOYOTA LEMON had NO BRAKES.

My BRAND NEW TOYOTA LEMON traveled through a STOP SIGN at a SCHOOL CROSSING.

What if my BRAND NEW TOYOTA killed a child?

Toyota U.S.A. would hire a gaggle of expensive attorneys.....

...you would have somehow BLAMED me for your DEFECTIVE TOYOTA.....just as you have in other cases.....

Mr. Toyoda, You've spent stacks of money defending your indefensible business practice, just as you have in my case.

How can I drive a TOYOTA with NO BRAKES?

Where were BRAKES listed as optional equipment?

Mr. Toyoda, You can clearly see that I'm not the only one complaining.

Mr. Toyoda, You killed this family whose last minutes were filled with the terror of a RUNAWAY TOYOTA before the TOYOTA crashed and burst into flames.

Mr. Toyoda, You then settled for $10 MILLION with a GAG ORDER so you could blame the dealership.

Hubris doesn't work!

TOYOTA has destroyed families, killed innocent people, injured many, simply because of arrogance and a refusal to correct your problems.

Of course, our insurance premiums have been driven up by your failures.

Mr. Toyoda, Driving a TOYOTA is like Russian Roulette and I don't gamble!
